Ok had the coffe number 1

so it goes @swanqueens848

if it is the beneficiary and it is on the ds-160.

be sure if that was an arrest or verbal or how it was recorded to avoid using the wrong term.

I don't know if U.K. Reveals the records to the person or is it a closed envelope? But if it reveals you can probably go and ask about it instead of using internet for this as wording is important.

Unless it was in the petition, it won't be an rfe but yes it will be necessary to explain at the interview. Be honest as I do not think this would be a huge issue. However I would definitely check what it would be called.

if it was verbal, be sure if there was a record of it or not. Not to hide it or not but to be able to explain correctly. Because here we use some terms more generally but sometimes it is not as bad as we think.

On DS On the petition it asks if you have ever been convicted. I told my lawyer I have been arrested and he laughed and said no, convicted.

I also had a previous ESTA where they ask if you have ever been arrested or convicted and we put no because we thought my record had been wiped and I still entered the country without fault.

So now we are, freaking out.

No freaking out!

Freaking out doesn't help anything. (Although putting no before can result in misrepresentation...) just research first if there's a way to learn for sure what is recorded.

this article above (at the very end)

"Under current rules, criminal convictions for under-18s stay on their record for five and a half years, while cautions last two years. Some offences are never removed."

May depend on the case.

It’s worrying us that we may have clicked no on the ESTA because we genuinely thought it meant conviction and any thing I had been arrested for or reprimanded for was meant to have been wiped. However I haven’t resturned to the us in two years and my ESTA is no longer anywhere as of I know.

All I know is clicking no wasn’t a good idea but I genuinely did think everything was wiped and it meant conviction, not arrest.

I know but what happened happened, you can say that's what you have been told and show them where that's written under the current law (which obviously happens).

i just edited my above post and put a link on it, try to research or ask your police station about what's happening in your case.

@swanqueens848

even when we talk here you're not sure if it counts as an arrest or caution or what it is. It is not your fault, just learn the right terminology in your case first. Because it sounds just worst depending on which words you use.

hi @Naes The link in had in your signiture doest seem to work (https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/list-of-posts-k1-k3-visas.html) .. so you have another one where I can look up country specific K1 documentation required?

It does work? I just clicked the link you put.

but they do not have details for some countries I think. This is their official site so I do not know any other official site for it.

*let me check if they created one more page though.

If you go to travel.state.gov and type in the search box your specific country it will bring up a hyperlink for that page and all the docs are listed if you scroll down a little bit

You’re right. I guess we just wait and see what happens. I will be sure to mention on the DS form that I was arrested and I will explain if we get to the interview stage.

I was arrested and reprimanded (loose caution) that’s all I know of. All I know is I was told it would be wiped when I was 18 and wouldn’t show up anywhere. When we did the ESTA, we must have misread what it said and that is our fault but I am hoping if it does come up, I can explain.

It’s okay, it’s just by this point we really think this isn’t going to go in our favour and unfortunately she cannot come to the UK so the stress as I’m sure you all know is awful.
