I'm sorry, Sir. I'm totally lost as to what you are trying to say. Are you referring to the AOS instructions?

I'm referring to the I-864 instructions, yes.  You are asking about the I-864.  AOS is an abbreviation used here for both "Affidavit of Support" and "Adjustment of Status".  Beware context.

I find spoon feeding to be less helpful than form instructions.  If you don't study the instructions, you won't know what all you don't understand and will miss asking for some critical spoons. We are actually here to HELP each other, not just answer the questions people ask.

First question, why would your accountant tell you to file single if your married? It doesn't matter if your spouse is out of the country. I had to file married filing separately because my spouse is not here and I didn't get him an ITIN number. Second that is a red flag for any type of spouse visa to the consular officer to file single. Now the IRS won't look into your marriage status so it was easy for you to file single. But when the CO looks at your papers he is going to wonder why you filed single.

You're absolutely correct, Sir. Thanks once more. Another question, did you submit tax copy or tax transcripts?

If you were married in that tax filing year, you will need to amend your taxes. MFJ, MFS, or HOH.

My tax preparer filed single for me, even though she knew i was married, so ive amended my taxes.

Providing tax transcripts is the easier then making copies of all your tax information, and its free from the IRS website

Ok I understand. So did you amend your tax return after the beneficiary came to the US? Or you amended it before...?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I have had it amended already, my beneficiary is not in the USA yet, and i wanted no issues at our interview because of tax status filing

I tried to tell that to my tax lady, and she argued with me, :wacko: i told her it may not be an issue for you,. but it is for immigration.

You need to amend it now. They will look at your taxes when determine your beneficiary's eligibility for the visa. (Your timeline says spouse visa so I'm going off of that).

So you send the amended tax return to National Visa Center or at the Consular Office during the interview?
