Timeline

when I was visiting my wife( then girl friend) I was arrested for a DV but my charges were dropped to simple assault and was given $65 fine and 6 months probation and my charges were dismissed after completion of my probation. Fine is paid and probation is completed. I was arrested on 01/01/2016 and probation completed on 20th Dec 2016. I got my green card through my wife on 03/7/2017. I did turn in my arrest documents to embassy before I got my green card issued so USCIS has my arrest record. As per my green card I am eligible to apply for citizenship 12/07/2019 as I am married t o US citizen. but my question is should I wait three years from arrest or probation completion. how this works?

hello Bruh,

we have a similar case together, I am married to a citizen and got my green card....should apply by for naturalization by january 2020.

based on my case, my lawyer told me that I should wait 3 years after the dismissed case.

Yes.What I have figured out after reaching to top lawyers in my state. if you are married to US Citizen then the statutory period is 3 years and your good moral period starts from date of conviction or date of completion of your probation. For example: if you got convicted on 1 August 2016 you can apply anytime after 1 August 2019 . Another Example is  if you got convicted and you chose a plea deal and offered probation for six months. So lets say your probation ended on August 20th 2016 you can apply anytime after August 20th 2019. But no more arrest and your charges must not fall on CMT list as well.. Its a complicated thing. I had to involve lawyer.

Hi there!! Actually my application process doesn’t start until next year but I was going crazy with all the formalities and steps.. I just preparing in advance what needs to be done so my process goes smooth.. consulted few immigration lawyers and figured out that it can be hard but it’s not impossible.. just wanted to share what I have learnt from lawyers and helps someone who is in same situation.. but what I have learnt never ever go against law.. it’s just not immigration but it’s can affect your job and career as well.. I am into finance and information technology and at every step I have to give an explanation..

After your case is pronounced dismissed. If you have 6 months probation, you should wait at end of the 6 months the judge tells you that you are discharged.

But don't forget to take your disposition case from the clerk of the court house. You will need it when you will have your interview for a naturalization.

Yeah it follows you around for the rest of your life, unfortunately.
