I was told that if you are applying for AOS from a K1. The medical is valid for one year after filing AOS. (assuming it didnt expire before AOS filing). 

 

Basically you would need to be approved within one year of applying for AOS. If it takes longer than this then your medical would expire.

This means that as long as you filed AOS before the 1 year was up, you should be good to go. I'm not sure how this pertains to medicals from your home country, but I would assume USCIS treats them the same as if you file an I-693.

per the first part of the link. The medical is valid for submission for AOS for one year. It basically resets the clock for one more year post AOS for validity. 

 

There was someone in my local office that had their interview 13 months after they submitted their AOS paperwork. The medical expired after 12 months from the priority date for their I485 and they had to receive a new medical unforunately.

Did they have to get a full medical, the same one they got for K-1?

Yes but if your office is too far behind then your medical could expire before the interview date. The link you sent said just that. The medical is valid for one year post submission of application.

Oh sorry I didn’t answer the question. That I am not sure of but they were required to follow up with a civil surgeon.

Hello! And sorry about the randomness of my message. I filed my AOS one day before the medical exam’s expiration date (considering the 1 year validity - when the doctor signs it) and USCIS received it (my PD) exactly on the 1 year mark. Although I already have the aos interview schedule for next month (so the 1 year reset post -filing wouldn’t affect) do you think I should have another medical exam done? :/ would you do it? I’d gladly appreciate any advice! 💕

Timeline (From B2 visa to AOS)


July 15, 2016 -> Got married
August 3, 2017 -> Mailed AOS packet (I-130, I-485, I-765)
August 4, 2017 -> Package received
August 14, 2017 -> NOA for I-130 and I-485 (not I-765... called multiple times to ask about this but was told to wait)
August 25, 2017 -> NOA for Biometrics Appt (I-485)
August 30, 2017 -> Sent email asking to look for I-765 (My I-765 was LOST)
September 8, 2017 -> Biometrics Appt for I-485
September 26, 2017 -> Received email from USCIS I-765 found and PD August 4
October, 2017 -> NOA for I-765 and Tier 2 officer cancelled 2nd biometrics

November 3, 2017 -> Raised SR online for I-765

December 11, 2017 -> SR showed as "completed" by the assigned officer

January 8, 2018 -> Name was updated 

January 18, 2018 -> interview scheduled

I don't know how much advice I can give. I know the couple at our local office with the expired medical only found out at the interview (the couple's interview was 13 months after their priority date). They were told that they can not approve the case until they receive the updated medical. They had to interview and everything went fine. Then they made an appointment with the civil surgeon for the updated medical and turned over the paper work to the local office and they were approved shortly after they turned over the paper work to the local office. 

 

It sound likes IF you find out that your medical had expired then it would be a similar situation.

Interview Question: 

For the K1 interview I supplied my husband with my past 1040s and my past W2s. I realized that tax transcripts are preferred. Unfortunately I had my Identity stolen 2 years ago which has caused the IRS not to allow me to log onto their website to request Tax Transcripts. I tried applying for them through the mail but don't know if they come on time. 

 

Will they accept my past 1040s and W2s in place of tax transcripts at the AOS interview.

Timeline

It is been 150 days since my biometrics and 101 days since I got an approval on my EAD and AP. Still no interview date or any update on that matter. Anyone of you has the same situation?

 

I know I should be grateful that I already have my EAD but there are companies who are still apprehensive to hire me due to my status or maybe I am not really qualified. :( though thank God finally I got a job offer after half a year of waiting.

 

Anyhow, when I called the call center, our local office is processing applications they received last January 2016 :o 

ROC JOURNEY

02/13/20  --- ROC packet sent  

02/18/20  --- ROC packet received Texas Day 0

02/21/20  --- SMS notice received EAC (Vermont)  Day 3

02/26/20  --- NOA 1 received - Extension Letter  Day 8

03/16/20  --- NOA 2 received dated 03/06/20- Biometrics schedule  Day 27

11/05/20  --- Notice of transfer of case to NBC  Day 261

02/26/21  --- Case is Ready to Be Scheduled for An Interview  Day 374

We both don’t want to cancel however she’s contagious But I know we need to 

My EAD is valid till November 

Any advice on what to do - should I call and explain the situation tomorrow or wait and call Monday morning

Has she already started antibiotics? You are only contagious 24 hours after starting antibiotics.

I believe you meant to say that your local office New York is processing AOS cases received last January 2017! If they told you 2016 it should not be correct as it does not matches what they have posted in their website:

Field Office Processing Dates for New York City NY as of: October 31, 2017
Form Form Name Processing Cases As Of Date:
I-485 Application to Register Permanent Residence or to Adjust Status January 31, 2017
N-400 Application for Naturalization April 16, 2017
N-600 Application for Certification of Citizenship January 16, 2017


Depending on their pace they could perfectly be processing cases from March or even April 2017. More likely July 2017 applicants from this office will start getting interviews pass the one year mark.

I mean maybe, but these processing dates are notoriously out of date. I know of many people who's field office is allegedly processing cases as of January 2017 who have had their interview and been approved already. 

 

Chicago is processing cases as of January 5 2017 and there's been a big influx of filers from June and July getting their interview notices.

That's good to hear-- our office (NOLA office) is still on cases from December of 2016 as of October 2017 so I was feeling like we were at least six-seven months away but maybe we'll be in there sooner than we think. I'm so tired of waiting!!!
