On Saturday, the case status for the EAD updated to "New Card Is Being Produced". It was funny because on Friday night, we were out having drinks with another couple and literally told them that the card should be produced any day now. Both of them are immigrants from Italy through work almost two decades ago, so they were curious about the marriage based process and how things are now. Oddly enough, AP remains unchaged, so I guess we will receive two separate cards and not the combo card. We will see whenever it mails.

We never know what to expect with USCIS, but glad your status changed and hope you will receive a combo card.

Our AP never changed and we got our combo card. Its been about two weeks and the website still hasn't changed.

Hi everyone, 

 

Following up on the discussion which everyone seems to be facing. We filed our AOS packet with I-131 and the EAD on 7/9/2017, received the NOA for all 3 on 7/19/2017 and completed the biometrics 8/8/2017. Still no word yet on AP & EAD. We received a RFE for the AOS in October and working on getting those papers sent back to them. This puts us at 110 days so far. 

 

Would this affect the EAD and AP? Or is it just backed up still? 

 

Hoping we get the AP before Christmas time so we can go visit!

Why does this not surprise me in the least bit?  Hopefully, we will receive because my girl has been really wanting to travel across the border and check out Vancouver.  It would be nice to be able to do that over Thanksgiving weekend.

RFIE will affect your timeline, RFE should not. We filed on July 2nd so you should be receiving notice roughly this week (if there is any rhyme or reason to this, which there might not be).

It depends....some cases yes and some other cases not. I would always wait for the worst (but thats just me). Here is what USCIS says;

 

In certain categories, we cannot process your Form I-765 until after we approve another application/petition because that approval is the basis for your application for employment authorization.

• For example, if you filed Form I-765 together with Form I-539, Application to Extend/Change Nonimmigrant Status, and you are basing your Form I-765 on the nonimmigrant status or extension of status requested in the Form I-539, we will begin processing your Form I-765 after we make a decision on your Form I-539.

It is very likely to be impacted as well, specially if you file everything together. Put your self on the US agent shoes, if you do not have enough proof why would you release other documents to the applicants, specially if they are under a VISA Check. Hope for the best, prepare for the worst. 

 

It is hard but the Visa Journey as a all it is very complicated sometimes and we have to do our best to avoid any issues (RFEs etc).

We have already had interview, submission date for AOS July 10, Biometrics Aug 8, Interview 10/10, green card in hand 10/24
