I don't think it will affect the EAD since the I-864  is only intended for AOS. I am sure it will be smooth after your answer to the RFIE. God bless!

Unfortunately yes, it does. I received an Request for Initial Evidence back in August - spoke to a tier two officer and was told that any Request for Initial Evidence resets the clock for the EAD and AP down to 0 days - and they start the counter again from the date they receive the response.

They can issue an RFE at any time, some people even receive RFE's after they've had their interviews.

Since it wasn't the card, how does the letter look like which contains the card in Informed Delivery? I haven't had Informed Delivery when mine came and it's been a while...

Was a stressful journey full of ups and downs, cya in 2020 VJ. I'll be back when it's time to begin the dreaded I-751. Biggest advice - make sure you have a TON of evidence, be completely honest and you'll be fine. Good luck everyone! =)

I filed an SR the same day as you and it send to expect a reply by October 17th as well. Let me know if you hear anything about your EAD or AP. We haven't heard anything back from them besides the confirmation email.

Wow! That is disappointing! I thought it would only affect my AOS. Now I am back to zero. 😔 Thank you for the info

Exactly! It would have been better if they sent me the INITIAL request sooner then I wouldn’t have expect anything on my EAD as well. It’s been 91 days as of today.

I don’t think I will be hearing anything anytime soon, @Adam&Allison said they had an RFIE and theirs ( everything, from EAD to AP to AOS ) reset and back to zero. So in short, I will count the days again after I give my response. Ugh.

It is very disappointing - I know exactly how you feel because I felt the same way. The one thing I will say is that it could be different for you. My understanding on the whole thing is that some people who receive RFIE's, it doesn't reset the clock - it simply pauses it. However, for most, it resets. 

 

My status is still on 'USCIS Received the Response for Initial Evidence' - and it has been that way since August 25th. I've no idea if it's still at the NBC, or if it's at my local field office.

And the frustrating part of it too is that I am not sure if mine is gonna reset or just pause. It’s hard not knowing anything. AND my case online hasn’t even change - Fingerprint fee was received - nothing changed.

Call USCIS and ask to speak to a tier two officer - that's what I did. Figure out if it will reset. If they say it will reset, I would try and fight it - explain to them that you think it's unfair that they're sending an request for initial evidence three months after you received the NOA1, and if it does reset will have to wait over six months for work authorisation.

Here is more to my story. My husband was just recently approved for SSDI. And his income didn’t meet the guideline. It said on the RFIE that we can add all the assets and bank account statement covering 12 months. Well the thing is, since he just got approved for SSDI, he only had his bank account just recently ( for a few months at least) Does anybody know if, for example, we are only missing a certain amount to meet the poverty guideline, say $3000, can we just deposit that to his bank account and we will be okay? We will send our response back with all income, assets, AND bank statement covering a few months ( not 12 months ) PLUS the certain amount we are missing. Will we be okay?

Thank you for the suggestion. I will call them today. And I will update here what happens.

I just called them and yes, it will reset. They wouldn’t consider my point about just receiving the RFIE after 3 months of NOA1. The lady I talked to said that they will just put it ( AOS ) on hold but then when I asked her if it will affect my EAD application, that’s when she said that it will reset.
