we got no update online or anything so the letter on the mail was a huge surprise tbh!

It basically states that AOS from tourist visa will be denied!

The rule doesn't apply to citizens of 38 countires who don't require a visa.

Two different departments here. Tillerson is the head of the State Department (think Embassies, consulates, etc.).  USCIS/ICE/etc. are part of Homeland Security, a different department with its own sets of rules and policies. The rules that Tillerson mentions are not binding upon USCIS because they are not his domain. At this time, they are, at best, suggestions to USCIS on what they should do. Since they are not binding, these rules would only apply in situations like Consular Processing, where the State Dept handles the processing of the visa. Until USCIS states that this is their rule or updates the Field Adjucators manual to include this rule as well (either of which is entirely possible in the future, but has not occurred at this time), this rule does not apply to any application which is processed by USCIS.  Truthfully, this is not a huge change for the State Dept. They have long had a similar kind of rule on the books. This was just a modificaiton/clarificaiton/extension of that rule. USCIS pretty much ignored that rule and did their own thing, I expect they will do the same thing this time.

Yes, you can. This is actually quite common, which is why I always advice people undergoing AoS to hunt for jobs but just don't accept the offer (to prevent USCIS from thinking you are already working). You will just need an official written copy of the job offer when you submit the expedite request. .

EAD and AP are mostly processed at the NBC, from what I understand. There is a huge backlog right now. Current estimates have it at 110 days to get your combined EAD/AP card. Applicants served by low volume field offices right now are often getting the GC approved before the EAD/AP finishes processing. THose of us in higher volume offices on the other hand, are left waiting until our turn. If you have an important reason to get your EAD (like a job offer or financial hardship) then you can request to expedite it. Otherwise, all you can do is wait and put pressure on them by a service request (which may or may not help).

12/12/2016 - Case left NVC for BKK Consulate

01/10/2017 - After travelling via the slowest route possible (likely via carrier pigeon) BKK Consulate receives packet

01/16/2017 - Packet 3 Instructions received 02/28/2017 - Packet 3 Instructions Completed

03/05/2017 - Packet 4 received (now the fun begins) --> 03/29/2017 - Interview disappears from the schedule on the embassy website -->03/30/2017 - She goes to her interview, is told they need to verify her documents since she is Vietnamese interviewing in Thailand, receives a 221G with 'Verification of Viet documents' as the reason. Gave back her passport.-->03/31/2017-04/04/2017 - Case is being continuously touched. We suspect that our case was approved at this point but they didn't have her passport. --> 04/10/2017 (10 days after interview) - Email emabssy to inquire about updates and if there was anything we could do to move things forward. (3h later) - She is told that she is approved and to expect her passport soon (how when they don't have it in their posession?) After clarification, instructed to send our passport to them. Ship out passport in a rush to beat Songkran (which failed) --> 04/11/2017 - Passport at embassy according to Thai Post Office --> 04/17/2017 - Emailed to confirm they received the passport. They issued an evasive answer about Songkran backlog (they love evasive non-committal answers)--> 04/24/2017  Evening - Case changes from Immigrant Visa to Non-Immigrant Visa and a new case created date is given --? 04/25/2017 morning  (less than 12h later) - Case flies through Ready -->Admin Processing --> Issued

04/26/2017 - Checks mail, passport is there. No mention of it being mailed out. 

05/02/2017 - Arrives in the USA, without Issue

06/17/2017 - Marriage!

7/01/17- Mailed AOS packet to Chicago

7/03/17- Packet received

07/07/17 - SMS and Email notification of NOA1 for AoS, EAD, and AP

This is perhaps old news to some. But my wife was approved 9/25 for GC, which we are still awaiting. Just wanted to post here that we stumbled across many forums on what to do following receipt of GC, to make sure we missed nothing. We did not realize that you have to change your Social Security Card to an unrestricted type following AOS. My wife has had a SSN since she was here on a J-1 ten years ago, to work at a summer camp. However, it says she may not work prior to DHS Authorization on the card. Anyone with a SSN saying this or that they cannot work (anyone who applied for SSN after marriage with K-1) must have their SS "account" essentially changed to an unrestricted type so they can get a job.

 

This is easy enough: once you have the card, make an appt with nearest SSA office to have it changed. They change status on the spot and mail you an unrestricted card in 7-10 days. Cheers!!
