Wife got her Bio appointment.

 

NOA was dated 7/24/2017; ASC Appointment Notice was dated 8/4/2017; Date to appear for Bio is 8/25/2017.

 

We are almost 2 hours away from USCIS facility, so no chance to try an earlier walk-in.

Glad they gave us an 11:00 AM time so we don't have to get up in the dark and drive while half asleep.

Interesting if you read the July 2016 filing thread.

There, the Vermont group is progressing faster than the California group.

Don't know if this is a new trend, or just an aberration for the July 2016 group.

It was dated 24 July which was same day VT signed for the FedEx packet.  However it was not received by us until 8 August.  So 15 days either sitting on someone's desk in VT or lost (for a time) in the postal system.

 

Based on other's dates on NOA it strongly looks like a computer spits out the NOA as soon as our packets are logged in as received.

But no explanation why some receive in mail 2-4 days later, and some take 10 or more days with ours being a record 15 days.

Yes, it is true. The window closed on 21 Jul 2017. I imagine that we can probably make an inquiry after 30 days with no NOA1. Someone else who did the fee waiver also said that she did not get her NOA1 until after 30 days. She also said that they have 30 days in which to review the application for correctness before issuing a NOA1. I believe though that the date of receipt will still be the NOA1 date for the 751 as that is what shows on her timeline. I was inquiring of people who had done a fee waiver as to the timing difference and when I had looked at this person's timeline it did not seem to differ from anybody else's. But then she told me that she did not receive the NOA1 for more than 30 days. ...17 days so far for us from they day that USPS tracking shows packet received. Hoping to hear something soon. I am hoping this is the case. We did have an interesting thing happen on AOS though. When we received the conditional green card it was back dated to POE date on K-1 visa. But most of the others of my group going through K-1 got their conditional green cards based on the date of approval of AOS. Due to this our conditional freen card was only issued with a  one year approx. expiration date rather that a two year expiration. We have about one more week for the 30 day period and are hoping for no snags other than the delay due to approval of the fee waiver.

So just to update everybody on our status, we recreived our packet back last Friday. At first I was a bit nervous but the first words on the letter included in the returned packet read, "The Vermont Service Center is returning your Petition...", when I read returning I knew why. I was glad it did not say, "REJECTED".

 

So last year when we AOSed, the green card was issued not on the approval date of the AOS but with the POE date of the K1 visa. I asked around and everyone thought that this would be OK but as the letter in the return packet goes on to say, "A review of your U.S. Citizenship and Immigration Services (USCIS) records show that may have been admitted or adjusted as a conditional resident with an incorrect date of arrival. Your were admitted with a date of July 21, 2015. It appears that you should have been admitted or adjusted with a date of June 7, 2016. USCIS has updated your records to reflect your correct entry date." So it goes on to tell us how to apply for a corrected green card.

 

So as you can see we put out a bit of energy about 8-11 months early and must now reapply at the correct time and also send an I-90 for a corrected green card fortunately this is at no additional financial cost just time. It requires the application, I-90, a copy of the letter form USCIS about the error, and you must include the incorrect conditional card, not a copy of the card, but the actual card. This is a bit frightening to give up the card and wait for a new corrected one but it is what they require. They will also send a biometrics appt letter and then afterwards send the corrected green card. 

 

So we are unfortunately leaving this July 2017 filers group and wishing all well. We will join either of the March, April, or May 2018 groups as that is our proper time to apply for the ROC. Here is hoping this is the only snag we encounter, a small snag in the scheme of things.

 

In a side note, I guess a computer does not just spit out a NOA automatically based on the receiving of the packet. As it shows in our case, the I-751 does show a stamp of received 21 July 2017 but a NOA was not sent automatically. I do think that the NOA is dated based on the receive date but not sent until the petition is deemed properly submitted with the minimal requirements, i.e. complete application, proper payment and some supporting documentation. As we all know they do sometimes ask for more documentation (RFE) but it does not keep them from issuing a NOA.

I guess I will have to give that a try .. unfortunately I work and it is difficult to call during EST time .

My NOA1 date is 07/26 and I also haven't received my bio letter yet. Have you tried calling USCIS? I don't know if I should wait til the 30 day mark from NOA1 or call early.

Any of you guys had the change of address experience before?We are thinking about relocating. But we are worried that further notices won't be sent to our new address.

For those who had previous experience, did you receive any mail/email confirmation after the change of address?Were you able to receive approval letter at the new address?
