Thanks!!

First time it was August 16th, then September 27th,and the last time it was last week that I got e-mail: We are still reviewing your case.

I keep getting those emails, August 31st, September 17th, September 27th (3 times) and today again September 17th was the last time they took action. 😝

Those are generated emails, don’t mean anything. Are people who had got approved and got the “still working on ur case” don’t bother about it

Guys what happened if I get divorce with a roc pending??? I'm confused because my lawyer toll me that if a get divorce and if the uscis ask for more evidence we have to send a waiver i751 and we start at the beginning again.

I'm in the same situation. I've asked two immigration attorney's on what the best course of action is and each case of course is unique. My case is unique to me and yours will be to you, so please don't take this as the final word or what you should do.

Last week my wife and I settled on the divorce. It now means we have to wait 3 to 6 months for the final divorce certificate to come through. This is while the ROC is pending. The issue is, the ROC is potentially due within days/weeks if we are to look at case numbers (mine is right next to some of those that are approved). My immigration attorney's both told me to wait this out. Reason is if I let USCIS know of my situation, I will have to file for a divorce waiver which is no issue in itself, but the issue is they require proof of divorce within 90 days.... but California requires 6 month cooling off period before a divorce is finalized. In that situation, my divorce would not come through in time and my ROC would be rejected. I'd probably then have to go through the whole fiasco from the start, potentially even being deported (i have a child here which worries me sick).

However, IF you have the divorce certificate in hand then you  100% should let USCIS know. They will move you to a divorce waiver and you can simply provide your evidence  and get approved swiftly that way. The issue is for those of us that are pending when the approval is soooooooo close. We are damned if we do and damned if we don't. Sadly there is no "pending" box with USCIS, it is very black and white.

Hope that helps!
