This morning I went to uscis website to see if there was any appt available, was so lucky to find an appt available for today 11am, so I took it and when to get my stamp, my extension letter expires August 14th, got a stamp for 1 year and they didn't take my GC away.

Are California filer or Vermont?...

 

I can see why they refuse (well, some of them) to stamp your passport if you filed with Vermont - June 2017 filers started geting approvals already.  So there is a huge chance you'd have your approval by September (they don't really like you to have both - green card and a stamp) 

 

But if you a California filer - a I-551 stamp refusal doesn't make any sense to me. They know that NOTHING will happen in the next 6-8 months, at least. And you were there, already.,.. What's the problem to stamp your passport then?!... Don't get it, really.

Found another thread that's relevant to your situation, but not completely. 

 

Assuming your application will be touched in January 2018 since you're a CSC filer, there would be three scenarios in my eyes:

 

1. i-751 gets approved without an interview. In this case you should be ok. As far as N400 goes, and that's if you have that in mind for the future, I don't believe they'll look at when the divorce was initiated - it's the divorce decree that you need to submit. 

2. Interview scheduled. if you attend without your spouse, your petition will be denied and you will have the chance to re-file i-751 with a waiver. You'll need to make sure your legal status does not lapse during the process. 

3. You notify USCIS prior to a decision being made on your case without the divorce decree. This is the one I'm not sure about. 

 

You might be better off waiting? OR, this is a wild thought but are you able to move to a different city where it's in the VSC jurisdiction? If you do, your case should be processed much sooner. 

 

I'm sorry this is all happening to you, seems to be an unfortunate and sticky situation.

I’m a Cali filler. My papers supposedly are in the Kendal office in Miami FL. I don’t understand why they wouldn’t do it. I said sir it’s so hard to set appts though. There are no available appts and he said if I’m not able to schedule one  should just come by and ask to speak with the supervisor. He said he s not allowed to give a stamp a month before the letter expires

Wouldn't it be nice if they just had a rule and stuck with it? I can't apply for ROC until I am within a certain time frame, you would think they have a similar window or earliest date for the stamp too (I know this is asking a lot!!).

 

I have been watching appointment windows for weeks and finally got one for July 31. It will be past a year since I files, but 2 months from the letter expiration date. I'm worried though because I have international trips coming up and I have a work that is going to have me out of state frequently and without a lot of notice. Hoping they will be nice to me, but seeing this I am going to prepare to be sent away.

 

The thing that is so frustrating is that not only is it making applicants stressed out and nervous, but it is clogging their system up with wasted Infopass appointments. If they would just stamp when you come in, you wouldn't have to come back.. or if they would just give a consistent timing for the stamp, people could book appointments when they need it.

 

It drives me crazy!!

These guys are absolutely clueless. I got my stamp in June and they added 12 months without any questions and returned my GC as well. Every field office seems to have their own set of arbitrary rules.

This Monday I got my extension stamp in Texas. The whole process did not take more than 30 minutes.
Since my local office is not accepting walk-ins anymore, officers were calling us by name and one by one, then you had to follow the officer in charge of your appt to his/her office. So I do not know about other people experiences while being there.
The officer who gave me the stamp was amiable, asked for my documents and started checking my information. Once my information was verified, officer told me everything was OK and I got my stamp for one year :).

Officer did not keep my letter nor my GC.

Sorry that happened to you.

Offices are working differently. The first time I tried to get an appt was two months before my letter expiration date. The officer told me I needed to request an appt 30 days or even 15 days before the expiration date not before that, so I think your office has the same rule.

Do not worry, everything will be OK. I had my appt 9 days before the expiration date and got my stamp.

Did u guys apply for ur citizenship yet? I’m stuck at the tax returns,I couldn’t download them so I’m waiting to receive them by mail. But then should I resend all the emcee I sent for the green card? I just have upoloaded my greencard, my husband’s citizenship paper and the marriage certificate for now

If you can't get one then try to make an infopass appt at another field office nearby.  Might be worth the drive.

 

Note: some offices that are super, super busy have drop in appt but you need to get there super early as these offices only have a limited number available.  I have read that people have camped out to ensure they get an appt that day.

Each field office has certain guidelines they follow ie discrepancies.  I was refused once and told to return AFTER my extension letter expired (September, like you). however I went last week and got it.

 

Some offices are keeping the expired GC and extension letter, some are not.  Both of mine were kept.  Think of this journey as a box of chocolates.....you never know what you'll get :)

 

Hang in there and just go with the flow.....
