Hi friends, I am a US citizen ready to go to France and get engaged to my fiancé who is originally from Yemen but working and going to school there. My question is will I have any problems with filing this K 1 visa because she is from one of those countries that have been banned on Trumps list? Second question is if she gets approved on this Visa how long does it take before she is here with me in the US. Third question is if she is approved can we get married within the 90 days and can she go to France to finish her school, she only has 1 year left to graduate with a master. I am sorry to have asked so many questions but I need your help. Thank you in advance.

1) Not sure.

 

2) Maybe 5-6 months. Could be more if stuck in AP. 

 

3) After getting married she has to file for AOS. She cannot travel outside of the US for an extended period of time while the AOS is pending. Either file for K-1 a few months before her graduation or get married to file for CR-1.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

1) Not with filing. You may get more scrutiny at the interview stage.

2) The timeline is around 6 mos, but because of the country you may be put into advanced processing

If she needs to be in France for a year anyway and you're sure you want to marry, why don't you get married legally now and file for a CR-1? It takes a little longer, but if she enters the US at least 2 years after your marriage, she will not have to file ROC.
