Hello, 

I just joined here. My girlfriend, Aila, and I are planning to marry and be together via the fiance visa. I'm American and she's Filipina. We met online in December and I visited her and met her family in January. Anyways, we're working on preparing everything for our marriage and family to be. She's a nurse and before we met she did a travel nurse job in Saudi Arabia. Her lola passed away while she was there, and she didn't like some of the treatment there, so she returned home on her vacation and didn't return. Because of that she was never able to get her police clearance from Saudi and her boss there was making strange advances on her, telling her if she wants it she should come stay with him for a week in his vacation home, which is needless to say very creepy. Anyways, she is able to obtain a no derogatory for her criminal record for the visa. Does anyone have any experience with this or advice? I'm considering signing up for rapidvisa.com's services or possibly an immigration lawyer as we're very much in love and bent on being together. Thank you!

She doesn't need her former employer's help to obtain one.

 

Also, if you want a K-1, please do not go through any kind of wedding ceremony prior to her entering the US. You might be considered "too married" by USCIS or the embassy and risk denial.

 

I-129F/K-1 can be done by yourself. You'll still need to do all the legwork even if you're hiring an attorney or RapidVisa.

KULtoATL's advice is absolutely correct. You don't need the former employer's help and you don't need an attorney or visa services. You can do the visa with help from this website. It is a lot of work, but not difficult. Get started and don't give up!

 

(Make sure to have a lot of relevant documentation concerning times that you are together, photos of you with family, traveling, etc. No wedding-type photos or your K-1 is dead in the water. And go visit her as much as you can. Go to the interview.)

Police clearance letter is necessary for K-1 level. @WandY just confirmed what I said, that is, she doesn't need to go through her former employer or his help to get her police clearance letter. She is to apply for it herself. Hence, refer to the link I posted originally.

For the power of attorney part listed in the requirements it seems we need to have a contact there whom we can kind of hire to do the work for us getting the police clearance. In Saudi it has to be a man too. I realize the chances are little that anyone here can help me or put me in contact with someone who could help with this in Riyadh where she worked at the Saudi German hospital but I'm still hopeful. She already asked her supervisor there to help and even the CEO but it didn't help too much. I'm about to send the CEO a message asking for help or to direct us to someone he knows that is willing. Anything will help, thank you.

Was she there for less than 6 months? If so, she doesn't need a police clearance.

 

As far as I'm aware, its difficult to obtain a police certificate from Saudi Arabia if you are no longer a resident. For this reason its likely you'll be given a waiver at the interview for this requirement.

Billyduke, if you are planning to get married in the Philippines, then k1 visa won't be applicable to you guys. As for the police clearance, yes, she needs BOTH an NBI clearance from the Philippines and a police clearance from Saudi Arabia if she stayed there for more than 6 months. I worked in Turkey as a teacher for 3 years. I got my Turkish police clearance a week before I departed that country and I got another one in the Turkish Embassy located in the Philippines weeks before my US Embassy interview. Make sure to have the police clearance translated to English! This document will be very important once your fiancée has her interview.

She was in Saudi for 2 years but she did not get the police clearance or final exit visa from saudi before she left. Now, it's near impossible to get. Has anybody in this situation been able to get the police clearance or been able to get a k1 visa without it? I read that because of how difficult it is to get after leaving Saudi that it can be waved if you show this with documentation. Any advice that pertains to this is much appreciated. This is our main stress about our K1 visa. Thank you!

First let me say that you do not require a lawyer to process a visa through the Philippines.  Jump over to the Filipino forum at http://www.visajourney.com/forums/forum/129-philippines/ and there are many of us there that will walk you through step by step what needs to be done, where to go to get the necessary documents and tips/short cuts to save time and money.

 

Second, you cannot get a PC from Saudi Arabia once you have left the country. It's stated in the reciprocity information found here:

https://travel.state.gov/content/visas/en/fees/reciprocity-by-country/SA.html  It states and I quote "Police clearances are unavailable for third country nationals who no longer reside in the Kingdom."  The US CO at USEM (United States Embassy - Manila) will know this when you go to interview. If she has been elsewhere for more than 6 months she will need a PC but first check the link I gave you and search for other country's.

 

Third item is that I can see that you're very excited but keep in mind this a 6-8 month process, so having patience is going to save you a lot of headaches. Do overs are no fun!

I'm happy to have stumbled on this topic as my fiance is in this similar situation - worked in Riyadh for 3 years as an RN, but never returned. I was getting confused and worried with everything I was reading, so thank you for this clear information @Greenbaum. Cheers!
