He is on a J1 Trainee visa, working for a private company in marketing, receiving a salary. No Government funding.  Since his visa says on it "no 2 year required"  I'm just making sure that by submitting a copy of the visa, that's good enough to show that it isn't applicable. Thanks!

I think it should be enough proof.

I have my interview on Thursday!!!! I'm so nervous! My husband just keeps telling me that everything will be fine. I just wanted to thank everyone who posted about their interview experience. I will be spending the next couple of days making sure that I have photos etc ready. I'm still worried about what they are going to ask though. I'm worried that we got married so close to the end of my J1 that it will be a red flag for them (I have been here since August 2012, we met January 2016, engaged July 2016, married April 2017, J1 finished July 2017). I'm trying to be hopeful as we applied in July, I got my EAD at the beginning of October, and notice of the interview October 16th, interview is November 16th so it's been pretty quick!!!

I think you'll be fine. We got married in Feb 2017 and my J1 ended in May 2017 and we filed that same month, although we had been dating since 2014.

Our case move pretty quickly too, just answer everything honestly, no reason to get nervous!

Good luck!

It could also have something to do with the area that you are applying. Some areas are a lot busier than others and so it takes longer. Everyone's timelines are different. Good luck

Does anyone else in here have citizenship from a country impacted by the travel ban?

I suspect that the reason our case has not been transferred from the NBC to our local office yet is most likely due to that. At the past couple of infopass appointments, we were told it looks okay, but I'm not sure why it wouldn't have at least made its way to the local office yet, since our field office is processing i-485 cases as of January 10, 2017.

I also haven't received responses on the past two SRs (one filed in August, and one in November). They both recently got assigned to an officer for processing, but I have a feeling our case may be on hold indefinitely? Does anyone have any info or insight on this?

We have another infopass appt coming up, so we're hoping to get some clarification. But my husband is planning on traveling back to Iran over the holidays with the AP document, but now we don't know what's going to happen.

I have a question for all J1 filers who *weren't* held to the 2 year home rule.

Submitting an application with my husband, who is on a J1 with no home rule, and it says so on his visa. I'm assuming that the fact that is says this on his visa is the "proof" that he isn't eligible for this correct?   Just want to make sure we aren't missing something.  We have his DS2019 to submit as well, but he had lost his original DS2019 earlier this year and had to get it replaced, so the copy doesn't have the box checked for whether the 2 year rule applies or doesn't apply.   But I'm hoping that because it says it on his Visa that should be good enough?
Thanks for your help!!

It should be fine :) I'm the same case as your husband, i have the 2 year rule doesnt apply on the visa and on the original DS but when i extended the contract for another year, another DS was issued for me without the box being ticketed out and I called the agency and they said that that doesnt interfere with the 2 year rule thing :)

I’m in the same boat. Check out my post history if you want more details - no interview yet, but will be traveling soon on AP. Not too worried because the order has waivers specifically stated for AP, those who have been working and living in the IS, etc

Hi everyone,

I'm also a F-1 student in AOS. PD is August 23rd 2017.

When I filed for AOS, I did not apply for EAD because as a student, I am employed by my school, which is allowed by F-1 visa rules. And I do not expect to graduate any time soon (and I'm eligible for OPT STEM extension).

However, I'm getting nervous because I recently read that filing for AOS makes the F-1 status invalid. Therefore I need to have EAD asap. I think I will file for EAD immediately. But USCIS never sent me the NOA1 for i-485 and I am now waiting for a service request asking for the notice to be sent again. What can I use as evidence of i-485 filing in this case do you think? Thank you!

Aug 30 Email/text receipts of 3

Filing for AOS should not affect your student status. But, I do recommend having your EAD in case your F1 status ends before your AOS is processed. The EAD could take up to six months, so you should file for it now. It is free if you file with i485 and i131. But I wouldn't worry about your F1 student visa, it shouldn't be a problem.

I agree with what Imenko said. Filing should not affect your F-1 status, HOWEVER, if it's anything like J visas, you will lose it once your I-485 is approved.

I don't think you should be worried. If your end date is far in the future you are likely to get your green card first :) if not, you can just get the extension.
