On the last facebook group I asked this question people were saying I wasn't a man and a lot of other nasty things. I am not here for hatred, just help.

 

Hello I will keep my information a bit brief, but I think it is necessary to explain myself at least a little bit so people don't insult me for asking this question. I am a full time student and have 1 year left of studies. I do farm work for my family when I am not busy with studies and make about $6,000 a year from it (this money is not taxable so I have not filed income taxes the past two years), and I also get enough grants to fully pay for my tuition as well as $5,500 in extra money to do whatever I want with. I am the primary caretaker of my mother, she has many health complications and I do just about everything for her.


We are filing for the k-1 visa and my fiance will be having her interview late next month. My fiance is Moroccan

My problem I am having is that my joint sponsor is not agreeing to send anymore of the information we need (bank statements, and proof of employment), and basically told me that he gave me all that he is willing to give (which is his filled i-134 form, last 3 years of taxes, w2s, last months pay stubs, and proof of citizenship). It is now 4 days before I must send all the paperwork so my fiance has time to prepare for the interview. I understand that it is a lot to ask from someone, but we didn't have a back up plan because he assured us for the past 5 months that everything was fine and he would do whatever he could to help.

 

The only other option I have for a joint sponsor is my parents. They were my absolute last resort because my fiance keeps telling me you can not use SSDI as a joint sponsor, but every person I have talked to about it said you can use SSDI as proof of income. My parents wanted to be the sponsor originally but my fiance keeps arguing that it isn't possible.

My questions are, is SSDI a valid proof of income for a joint sponsor?
and if so instead of sending proof of employment and w2s, would they just send their letter from the social security office proving how much they get a month?

Honestly the joint sponsor you have now should be sufficient. Some embassies want to see banking statements and all, but it isn't really necessary unless using savings/assets.

 

W2's and tax transcripts help show consistency year to year, and recent pay stubs show current incoming income as the most beneficial to me.

 

Hopefully some other Morocco filers can give you their personal experience in dealing with the embassy there as to specifics that are asked for.

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Its none of my business, so you don't need to tell me, but how is $6,000 not taxable? When I was a student at University, I made only $940 one year and it was still taxable - as were my grants I got from going to school. Maybe it varies by the state you live in but even though I barely had any income at all (I had quit my job January 10th and lived off my grants) I still had to pay taxes for the year. 

 

Morocco is a difficult embassy - if you have other problems in your relationship - not too many visits, etc - this may be too much. Idk if SSDI would count as "income" - it may go by a lot of variables - family size, etc. Could your parents reasonably be expected to support themselves, you and your fiance all on only social security disability? That is a lot to ask of them. Even if it may go through as being a legitimate sponsor, that is still an awful lot to ask of them. There are a lot of fees involved in this K1 process (AOS, etc) and when she comes here and can't work for a certain amount of time and you still have to accrue fees that you aren't thinking about yet (who pays for your health insurance for example, who will pay for hers?).

They should send the SSA 1099 they get every year, it is the SSDI version of a W2. My parents were our other sponsors, my mother gets SSDI and it was no problem, she filled out the 864a and included her income with my stepdad's regular income....it is SSI that can't be used.

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

I dont mind answering you at all. I get paid under the table basically. I don't get pay checks or anything like that it is all cash. The only thing taxable in Pennsylvania from farming is the amount you have to pay for your land each year. Money you make from say raising cows is not taxable. The land also is not mine I just do the physical labor.

The healthcare plan I am on now I can add her to mine for 125$ extra a month (I can afford this easily) . It is the same thing with any joint sponsor though with the risks involved, and yes my parents are willing to help me. I explained to them many times what all is required and they keep agreeing to it. They get about $35,000 a year joinly from SSDI and also my father makes good money from his share of the farm work. When my fiance comes we will live with my parents for a few weeks until we find our own apartment. My parents are just excited to have their new daughter here and want us to be together.

will they need to fill out the 864a instead of the i-134? or did you use your parents for the adjustment of status part. We are currently on her first interview and the i-134 is what we were told to fill. Sorry I just want to confirm we have the correct paperwork :)

Sorry, I was speaking about our AOS.....your parents will fill the i134 first for the k1, then once approved, if you use them again as the sponsors, the 864/864a. I also sent you a PM. Don't worry, you've got this!

This question is going to be so specific I am not sure if anyone can even answer it.
My parents are my co-sponsor, but we put my Father as the sponsor and they both get SSDI (dad about $23,000 a year and mom like $11,000).
They filed their taxes jointly.
I am trying to guide them through the i-134 form now.
My question is that if my mom is considered a dependent or not? On the taxes it says she in an Exemption. This is what the front page of their 1040 looks like

I will be honest I don't know what the difference is between exemption and dependent, this whole thing has me really confused.

No, Mom is not a dependent. She is the spouse and has already received her exemption by checking Box 2--note that hers and Dad's adds up to 2. Son makes 3 and that's it. Only one exemption per person! :rolleyes:

okay so on the i-134 I will be the only dependent then :D thank you a lot this was confusing us so badly. My mom was like...... wait shouldn't my name be on the form somewhere haha
I told her no because my dad will be the sponsor and you can't have two sponsors on one i-134 :)

Hello my Father is my co-sponsor for my k1 fiance visa, and we are doing the i-134 now.
My parents said her and I are welcome to stay with them as long as we need to until we can find our own place. Our plan is to save for about a year and then move out to live comfortably.

My question is on the i-134 will my father check this box? this is considered room and board correct?

and for this part it asks you to explain what support you are going to give.

we would put page 4 : Part number 3 : item number 38 right?
and then for the explanation he would put like : I am prepared to offer my future daughter in law and also my son room and board for as long as they need it.
Personally I was thinking about having them right up a letter explaining this stuff but I don't want her trying to give the officers paperwork they don't want to see.

I think your parents should tick only I do not intend to make specific contribution, that way it is better.

I would like to ask you if you permit me,did the NVC assign a case number for you? how long did it took the NVC to receive your approved petition? and can you check on the USCIS egov case status if your approevd petition have been sent to NVC or you will know only if you receive a letter from them?

hello my sponsor filed taxed jointly with his spouse, and they have 2 children. My question is if his wife is considered dependent or not. On the form it says these people listed dependent upon me for support. His wife as far as I know makes no money, so my gut tells me to put that she is his dependent since she can't support herself and also his 2 children for a total of 3 people.

People have told me that wife cant be dependent, but on the i-134 it makes it sound like they just want a list of people that you support.

She's not considered a dependant for tax purpises but she's still considered in the household size.  So your co-sponsor would need to make above the poverty guideline for a household size of 5 (himself, his wife, 2 children, and your fiance).

ahhh okay so for dependents they just put their two kids for now
yep he makes good money so no need to worry about that.

 

do you know if the taxes need to be signed? my sponsor didn't sign his :(
