Will Vietnam Police Clearance be too old?

In the process of getting documents for our K1 application (birth certificate and divorce decree), my fiance also requested her police clearance certificate.  She has it now (dated May 2017) but we are waiting until after our August Dam Hoi to send the I-129 application.  Will the consulate want a newer certificate if the interview is not until January-March 2018?

Police clearance will likely be OK. I think the "running of the clock" is tolled when you file, not when you interview. We had zero problems with VN documents. Even my wife's birth certificate was accepted, and it was a ragged piece of paper that looked like it had been found in a rice paddy. :)

 

My best advice to you: Go to the interview and have copies of everything, especially financial, past marriage/divorce, and all the times you were together in VN. Go to the interview.

I will definitely be at the interview.  Even if I the embassy doesn't talk to me, they will know I am there.  More importantly, my fiance will feel better knowing I am there.  

 

We will have copies of everything along with all our originals.

From U.S. Embassy, linked above: "Original Justice Record Check #2: Must be issued within the past year by the Department of Justice office in your district of official residence for each beneficiary age 16 and over."

Thank you for posting that link.  It answers my original question, but raises a new one . . . I am looking at the record my fiance received, and it translates as "Criminal Antecedent Record No. 1." It is Form No 06/2013/TT-LLTP and issued by the People's Committee of Lam Dong Province, Justice Department. She told the office staff that the record was needed for a visa.  This is obviously not the Record No. 2, but is it a comparable substitute that the U.S. Embassy will accept?  Perhaps the #2 record is more thorough than No. 1.  Should she go back and specifically ask for the "Record No. 2."

Thanks everyone for the help so far.  I just wanted to respond to my last question in case it helps others - As noted on the U.S. Embassy's website, the police clearance certificate must be Form No. 2.  My fiance was mistakenly told by the Lam Dong Justice Department that she needed Form No. 1.  This form is only for student visas and for Vietnamese living outside of Vietnam and my fiance falls into neither of these categories.

 

She will return to the Justice Department to request the Form No. 2 on Friday.  Cost is 200,000 VND.(about $9USD) and will take about 7-10 days (but they officially say 3-4 weeks).  They are also providing a notarized English translation.  As noted, Form No. 2 is good for 1 year from the date on the certificate.

 

Thank you to everyone who responded or just read the post.  I am sure I will have more questions after I submit the application in September.  Until then, we are just counting the days until our Dam Hoi in August! - Jason
