Hello Everyone,

 

I am new here and I found this forum when I was doing some research on my particular case. I graduated this May as a F-1 student and already filed for AOS last Christmas however due to lack of evidence I had to resent some material back to the immigration office and I did it right before my graduation. I didn't realize I could file for EAD along with AOS and when I found out after sending in application for OPT I sent in a letter asking for refund with a new I-765 form. I just did my biometrics yesterday and wonder how long it would take to get EAD? Also, anyone has any idea or an experience of getting training without getting paid by the company while waiting for EAD?

I appreciate any advice/suggestions/sharing!!!

fill in your timeline, it helps to get an accurate estimate. Generally, it takes about 90-100 days and RFE adds time to that. If you have job offers, you could potentially file to speed up the process based on financial loss.

If you also filed AOS, I assume you got married to a USC?

Yes @DrEllaNJ my husband is a US citizen. I will work on my timeline.

My current issue is that the president of the private company would like to start training me while waiting for EAD but it's unlikely they would sign the contract before I get the card. I read a couple posts about expediting the process but they all had the offer letter.

@DrEllaNJ you are right they don't care and we all know it is not a cheap process to go through. I did call them about three weeks ago and the guy helped me file a request for refund and gave me a referral number to check into it. He said if I didn't hear from them after 30 days I could call back.

an offer letter is not the same thing as a contract I think... you can ask them if they can give you an offer letter contingent on obtaining work authorization?

I think you have to be careful even with unpaid work/training. I've heard of workplaces where they didn't even allow people without work authorization on the premises for fear of appearing to have ppl work illegally. 

Also, is the training something they usually require you to do unpaid? You also don't want to be taken advantage of, if it's normally something they provide after hire.

Some people have been waiting over 100 days for their EAD. I think that will be counted from the time they received your RFE.

 

I also recommend that you talk to USCIS to expedite your EAD. Here are some instructions:

 

Technically, you could do unpaid training. But it is up to HR to decide whether they want you to do that or not. If it is an online training, it might be easier.

@DrEllaNJ Thank you for sharing your ideas and suggestions. I have talked to the company again this afternoon and looks like we will have to wait till EAD arrives since at their management meeting there were concerns about me doing anything productive at the workplace being considered illegal.  Hopefully it would come soon since my biometrics is done. Actually I offered to start training for free because I am tired of sitting at home doing nothing and feeling frustrated with this long process. I appreciate people like you being so kind and willing to take time responding to my question.

Unfortunately when you do your biometrics has no relevance to when your ead will be processed. Biometrics for ppl that file ead with aos is normally around one month after filing (receiving appointment letter after 1-2 weeks) and after that it just takes the time it takes for your turn. Ppl lately have been waiting anywhere from 90-140 days..with odd exceptions even longer. Your best bet on getting it faster is that expedite as mentioned.

@YDCarter, I'm impressed that they are willing to wait for you to get your authorization, speaks highly of your qualities and of the company involved. You could tell them that there is a way to try to expedite the process if they can give you an offer letter (with the condition that EAD comes in)....

 

I totally understand the boredom of just waiting around! That's why I spend so much time on this forum :rolleyes: (I'm actually unemployed for unrelated reasons, but that's a whole different story)

Yes I just called USCIS to put in my request for expediting EAD. Trying to contact the congressman now.

The president is willing to help me speed up the process. He already sent me the offer letter and I am working on my end. I will keep everyone who's interested in my case posted. Thank you for your kind words.
