I 130 denied and planning to reapply again

Hello ,

 I filed i 130 around 2 years ago for my wife and it was denied. So adding more documents which were the main reasons for previous denial , I am preparing for my next applications. What are the documents or necessary  precautions that I need to apply ?

Any body had such kind of situations or informations,  please let me know. Any kind of help will be appreciated.

What was the previous reason for denial, and at what stage was she denied?

What extra documents are you sending now?

How often and for how long have you visited since?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As indicated in the post above, it's impossible to comment intelligently without more information.   Petitions are seldom denied.  Was the petition denied, so never got to the Embassy or Consulate, or was the visa denied and the petition approval revoked?  In any case, what was the reason for denial?

Thank you for replying. My previous i130 denied due to lack of legal document like marriage certificate. We got married in india during my vacation. Uscis asked me the marriage certificate where we celebrated our marriage ( india) but I provided only relationship verification issued from my born country. 

Now I gathered our marriage certificate, relationship verification , third party bona fide marriage letter and planning to submit my applications. Am I missing something.....???

Submit the documents indicated by the I-130 instructions, including an unsigned I-130a from your spouse.  Make sure you use the latest version of the I-130 and its instructions.  If you were denied because you didn't include a marriage certificate indicating your legal and lawful marriage, registered in India, then they MUST deny your petition.  Submit all required forms and supporting documentation, plus relationship evidence.

Thank you again for replying that quick.

Now,I gathered all of my required documents like marriage certificate and other evidences from nepal ,not India.

Does it impact my current application process because previously i told them my marriage occurred  in India and now I am telling them it happened in NEPAL.

Please advice.  Thank you

You can provide a cover letter explaining why you did that, which, depending on what the reason is, may or may not help.

Never lie on an immigration form.  Perhaps you confused the legal marriage place and date with your religious marriage date and place.  That can be explained.  If you intentionally misrepresented your date and place of marriage, that could spell doom to the new petition and any possibility of US immigration for your lifetime.

Thank you pushbrk for your information. 

That's what I i afraid of. They may get confused with my previously tradition marriage with my new legal marriage date. 

But uscis did not validate my tradition marriage because I could not provide them my legal marriage certificate. So I have to marry my wife again Lol,  in legal way to obtain legal certificates.

My advise is not to lie, I applied for my daughter and it was denied due to lack of birth certificate. When I applied again I explained why i did not have it at the time of applying and submitted the birth certificate and it was approved.

 

Never lie in an immigration process because you never know when and how they will found out about it.

Thanks that's really helpful. I did not lie to Anyone. It's just i had to marry with same girl twice to get the marriage certificate.

And now I have a marriage certificate but the date is recent ,not the one with traditional marriage date. It's a huge confusing.
