HI everyone!

 

finally almost a year waiting something moved..but not what we were hoping for. 

We just got a RFE in the mail asking for more evidence. The problem is that I really don't know what else to add to what we already sent. Unfortunately we live with my in laws so we don't have any bills, mortgage or anything,like that together. 

We sent tax transcripts of joint taxes, joint bank account statements, joint insurance policies, life insurance policy having my husband as beneficiary, car insurance and lease together, plus plane tickets and pictures. 

 

Any my suggestion on what to add??

 

im also 9 month pregnant, due the 25th..this is just so stressful. I appreciate any input!

We were with the in-laws as well, in fact, we still are. My MIL wrote a statement to the effect that we lived with her, and we sent that along with our ROC package. We also sent things that showed the same address, drivers licenses, mailed envelopes from the banks addressed to both/either of us showing the same address.

I can explain it to you. But I can't understand it for you.

Thank you so much, I did sent copy of licence and letters with the same address.. I'll definitely add an affidavit from my in laws, and for the hospital I had to fill out a power of attorney, I'll include that as well. 

I really thought we had good proves :(

Get every single bank/credit card statement between when you applied and now. As @cdneh (I see what you did there!) said, get your inlaws to make a "lease agreement" for you. Go online and create wills, powers of attorney, living will, etc. and submit those. Get some affidavits from people who know you as a couple... Your 2016 tax transcript, etc. Concentrate your new evidence on the time between your application and now. At the very least, it's another year's worth of evidence. At worst, you'll get called in for an interview and you can prove that you're really a couple in person.

Those both should help. I know it's tricky when you don't have bills in your name, or deeds or rental agreements.  Congratulations on the baby, and all the best!

Thank you! We only sent a couple of bank statements per year from 2013-2016, I will make sure to send every single one of them. Do you think I should send also the ultrasound pictures or better wait for the baby to be born to include the birth certificate?

The birth certificate is better, since it lists the father. However, maybe send a happy smiling snapshot of the two of you holding the ultrasound! That way you can respond to the RFE sooner!

Yes I'm now debating if I should wait for the birth certificate or not..I kinda wanna send everything now but maybe waiting is the best option and in the meantime get all the rest ready to go.

Just double check the wording on the RFE... they sometimes have a specific number of days in which you can respond. Despite the fact that they're taking ridiculous amounts of time, if they say you have 28 days to respond and you respond in 29, they can deny you. So if there's a date you have to respond by, make sure you don't wait too long!

I do not understand why some people get rfe,s for more info and others do not. Example- today we just got our letter saying roc was approved and we sent only 1 bank statement, 1 electric bill, 3 years tax returns, health ins and auto insurance and a letter stating everything else was submitted with aos. That was it and we got approved. I was pretty sure we were going to get an RFE for what little info we sent but we never got one and we escaped the dreaded interview for the second time.

But I guess when you are dealing with the government no one ever knows what they are looking for.

I really don't know how they make decisions.. I knew we didn't have a lot of "financial" proves since we live with my in laws, for which we sent an explanation with all of our driver licenses showing same address, we own 2 cars together, debit and credit cards, we sent life, health and car insurances, tax returns, pictures and boarding passes. But smth I did notice is that in the letter they send a list of "documents submitted" and a lot of what we sent was missing from the list and some were totally wrong( it said"new York driver license when we have all New Jersey ones). Who knows. We are sending all we can, but not much has changed as of living situation.

We will wait for our baby to come and send in the birth certificate, add all the bank statements, power of attorney, 2016 joint tax returns, and in laws affidavits. Hopefully this will be enough!

Not sure if this info is true, but according to a friend of mine who's an immigration lawyer, it's really easy to get approved when the couple are financially stable and have stable jobs. 

We're also approved without that much evidence, just insurance docs, tax docs (only from after I got my conditional GC), pics and vacation records and the P&S of our new house. No kids and no affidavits. We didn't include anything of the first two years (I was thinking they got that stuff already) but we both work for well known companies and I kinda think that helped. Also, my friend told me the nationality of the applicant has some effect to it, this doesn't sound fair but I think very possible.

In the RFE they describe what they want. Even if you sent it already, send it again. It would be helpful to know what they asked. Can you post the letter (covering private info)?

There's more to ROC than money.  Being able to demonstrate a commingling of lives is very important. Things such as child's birth certificate, common address on drivers licenses/id cards, joint memberships, joint credit accounts, mail addressed to the both of you, both listed on car insurance, medical insurance, life insurance, membership in religious organizations, etc. A joint savings account is also good. All the things that are typical of a married couple. No one couple will have all the types of evidence.

 

We did not have a lease or a mortgage, or bills in our name and I wasn't working at all. We did include a letter from my MIL to state our living situation.  We did not get an RFE or an interview.  You can only send what you have.

Make careful note of the day you must have this RFE responded too, and do not miss that date.
