Hello! My fiancée is here in the country and we're working on getting everything ready for the wedding (YAY!). We've been also preparing the paperwork for the work and travel authorizations, since on the Step-by-Step Guide on How to File for Adjustment of Status for K1 and K3 Visa Holders page it says that we can apply for those, and since her family is a stone-throw across the border away, we want to be able to visit them. 

 

The I-765 is the Work authorization and the I-131 is the travel authorization, and the instructions say to submit those with payment at the time of filing for the Green Card. That's where I start to find some conflicting information; from the NoLo Legal Encyclopedia I found this article that states:

" As part of your application packet, you can include a Form I-765 requesting a work permit. In fact, you won't have to pay anything extra for it if it's included with your adjustment packet "

 

This isn't the first time I've heard that, a few people have told me it and I found 3 different internet articles saying the same thing. However, I can't seem to find any correlating information on the USCIS website. Is this true, is there a way to not have to pay the $410 fee with the work authorization? Or is it just an internet rumor? And can this fee be avoided for the I-131 travel authorization? If not, I understand, but I wanted to ask... between the two documents it's around $1000 in addition to the already over $1000 Green Card application. If the fee is necessary, we might only submit for the travel authorization since that's the most important to us right now.

When filing EAD/AP with the AOS package the fees for the EAD/AP are waived.

 

So yes it is true. It will take around 3-4 months for the EAD/AP to be approved from when you send in the package.

That is some of the best news I've heard all week :D Is there anything particular I have to do to get that waiver or do I simply include the I-765 and the I-131 in the application with their proper documentation but no extra check outside of the one for the I-485 adjustment of status?

Just include the I765 and I131 forms with the I485 submission including all the required items for those forms (some of the information may be duplicated).  Make sure you note them in your cover letter as well, but there is nothing specific that you need to do to get the fee waiver.

Yep it always nice to save. Just include the forms in the package and the check for the AOS amount + bio fee
