WITHDRAWING A PENDING AOS CASE

Are you the applicant/beneficiary of the I-485 or the sponsor on the I-864?

You need a written letter from either the applicant of the I-485 or the sponsor on the I-864, and send it via mail to the office that has jurisdiction in the case with a copy of your ID.

If the application is in a Field Office, you can schedule an INFOPASS and withdraw the application in person, but you still need the written letter to give to the immigration officer, which will become part of the record (and they will check your ID).

As soon as you withdraw the application, the following will happen:

- An withdrawal acknowledgment letter (in the form of a I-797 Notice of Action) will be mailed to you;

- Any employment authorization or advance parole based on the pending I-485 is instantly revoked;

- If you don't have any other legal status, you will be instantly considered out of status. Legally, you can leave the country OR refile for another immigrant petition and/or I-485.

NOTE: An application that has been withdrawn cannot technically be denied, even thought the after effects are the same.
