Request Expedite message?

Hello, 

 

So I have pending AOS with Combo card. 

 

Yesterday I requested Combo card expedited because I may lose current employment based on OPT EAD that is gonna be expired soon. 

First USCIS agent said to me, I can't request expedite because she doesn't know how to. 

Second USCIS agent said, I can only request "Beyond time processing" because I have RFE in Feb, 2017, RD was Nov, 2016, so she said she can only do "beyond normal processing time"

Third USCIS agent finally said I can request expedite and that is where I made expedite. and I don't think it was tier1 or 2 officer, but just customer service agent. 

As instructed, I have delivered all my information and circumstances for why my case could be under expedite criteria, but never had chance to talk higher tier officer. 

 

Today I have been waiting for response (preferrably in email as it is much faster contact), but no contact was made.
Instead when I check I-765 in myUSCIS, it says my expedite request was completed and response was sent.

 

So I am assuming that it is mailed to my address, and therefore, I have a feeling that it only means they are not gonna expedite my request 
but will process combo card upon 90 days rule even if my current employment is gonna be terminated and may cause financial loss to me. 
Does anyone know this? 

 

On the mean time, I visited local congresswomen's office and asked the case worker to give all documentations to deliver to congressional liason today. 

In the worst case I will have to visit local infopass to deliver issue but then Chicago USCIS field office is always packed.

I was in the same situation as you - risked losing my job without an expedite. Just to ease your frustration a little, before my expedite was granted, the status changed to "my expedite request was completed and response was sent" a few times. I was so worried because I had received no email, I called customer service and told them that I was told I had gotten a response but I received no email so I am unsure what the "response" is. This got me transferred to a Tier 2 who told me it looked like my expedite was approved. 1 or 2 days later, my status changed to card being produced.

 

Here was my timeline for the expedite. The dates might be off slightly because I don't actually recall:

Day 1: Called customer service and put in expedite request (all verbal - no tier 2 necessary)

Day 1 or 2: Status changed to "expedite request completed and response sent"

Day 1 or 2: Received email from USCIS requesting evidence of emergent need for EAD

Day 1 or 2: Sent fax to USCIS with evidence of need

Day 3-5: Status changed to "expedite request completed and response sent" about 3 times

Day 5: 'Next steps' changed to "your case has been suspended while we request your file"

Day 5: Call to customer care to ask about lack of actual "response as indicated on status. Transferred to Tier 2

Day 5: Tier 2 calls back and discusses - says it looks like expedite was approved

Day 6: Status changed to "card in production"

 

Perhaps try calling to get to a tier 2 to get the fax number and officer code to fax your evidence over.

That being said, did you actually get "USCIS response when the status says "response was sent?" either through by mail"?

I am curious what would it state in the response if you get the response? 

Or it looks like you just get email asking you to submit evidence of emergency for EAD

 

And you gave all the documents to congress member as well?

Yes, I also asked for help from my congressman. Others have gotten approved without this, but I was desparate not to lose my job so I contacted EVERYONE!

 

The first "response" I got was the email asking for evidence of emergent need. The only other "response" I got was a mailed notice that my EAD/AP had been approved but these came the exact day as the EAD/AP card.

 

Another person who filed the same time as me said he got his request for evidence in the mail! I'm not sure why I got the email and he got mail. So perhaps USCIS has mailed you the very same thing they emailed me. This is what I got:

Thank you a lot for your specific detail. I am aware that local USCIS has different practice as to contact applicant, so in my case they prefer mail, or will wait for this. Anyway, when I contacted my congresswoman and asked for where the process is, out of blue, I was scheduled for interview but no luck with EAD/AP, stating that it is still under normal processing after RFIE so if it is under expedite criteria, it encourages me to apply to expedite request ("It is burden of applicant to prove that circumstances are under the criteria").

 

The problem was USCIS scheduled us for the interview a week after my current OPT EAD is expired, which is bitter sweet because nobody wants to lose employment a week before USCIS interview. When everything goes successful, I will post a review!
