i-864 for CR-1 -- When should it be filed and by whom?

Hello All,

 

I'm planning to travel abroad and get married in the the next few months. My understanding is after marriage I should come back to the States and file an I-130 for my wife. But nowhere on the I-130 form or I-130 instructions does it talk or say that I have to fill-out an affidavit of support!!! I've also read the I-130a and same thing, it doesn't mention affidavit of support!!! (unless I've missed it)!!!

 

I've asked around and someone said that I must provide an affidavit of support (specifically an I-864) for my spouse. So my questions are..

 

1. where does it say so?

2. when should it be filed (i.e. should I send it to the INS along with the I-130 + I-130a + email/communication form)?

3. or should I fill it out, mail it to my wife and have her take that to her interview?

 

In other words, at what stage should this I-864 form be filed and by whom?

 

Can someone please shed some light on this...

Thank you for your reply! I don't know about you, but for me, if I come across a page that has some OUTDATED information, I have hard time trusting and relying on the content of that page! In this particular case, if you go to http://www.visajourney.com/content/i130guide1 then scroll down to "Forms Needed to File for a IR-1 / CR-1 Spouse Visa:" and you'll immediately see that the info is NOT up-to-date! Those 3 forms on there are "history". USCIS have recently revamped their site and the updates are NOT reflected on VJ's Guides! So my hope was to get a response from someone who has recently gone through the process, and understands at what stage each form ought to be filed and by whom. I'm not really looking for references to pages or posts dated back to 2011 or 2008 LOL ;) Cheers!

Timeline

The I-864 will be sent to the NVC after your I-130 is processed at one of the USCIS centers. So, first you'll file the I-130 & I-130a with all supporting documents. Depending on which service center it eventually gets sent to, you'll then wait about 5 to 9 months for your case to be sent to the NVC. That's where you'll go through the next phase including providing the affidavit of support with I-864. Good luck 😊

1-08-18 NVC Received case

3-16-18 Uploaded Civil Documents

3-21-18 Uploaded AOS Documents 

3-26-18 Checklist to reupload docs

3-29-18 Finished uploading docs

4-4-18 Case Complete

4-13-18 Received interview email

5-18-18 Interview date 

5-24-18 Visa Issued

You won't see instructions about an I-864 in a visa case because, although the I-864 is a USCIS form, USCIS does not issue visas.  Download the I-864 and its instructions, then study the instructions carefully.  You'll be "applying" what you learn there when your case is with the Dept. of State's National Visa Center, several months after filing the petition.

 

For now, follow the I-130 instructions you will study carefully before beginning.  They are up to date.  The VJ guide is correct as to the overall procedure, but not as to the current petition filing details.
