While AOS pending, can I apply and get state ID?

hahaha...thanks....i had read the entire FAQ on how to get a State ID or a driving license and in the "Documents Required" section i saw Hunting or Fishing License under Proof of Address and so it was easy for me.

I haven't counted exactly but most states I have checked allow it - the employees at the DMV are another story...

Timeline

I was able to get my Michigan state ID after applying for AOS. I just had to take my NOA1 to show I'd applied and my ID was valid for 1 year. If you go to SOS they will give you a checklist of what you need to get an ID card

Yep, there are a lot of employee's out there that are not aware. The whole problem is the SAVE system. It requires a specific code for the NOA and very few people know that one. As far as I am aware, the whole thing is a Federal requirement/system. Once you're cleared in that system you're set.

 

This does not only effect foreigners. A friend of mine let her license expire 2 days (she's a citizen by birth) and now has to find her birth certificate to proof to DMV she is legal.

You're right, It is a federal system, but some states have imposed extra requirements on top of the lawful presence that you can't meet without an EAD and or GC - unfortunately.

Thanks dear.. I will try that hopefully I will get AOS NOA1 until next week... do they check if your visa is expired??  My passport is valid but my visa is expired.

don't think they check your visa. As long as your I-94 is valid and you have proof that you're currently applying for AOS you'll be fine. When you receive the ID, just know it's only valid for 1 year because that's how long they anticipate the green card to take for approval. If you get the green card before the ID expiration date then head back down and show them proof of green card and residency so they can update the ID. It might be worth looking into a drivers license too. Works the same way!

If you're looking for a state ID / driver's license, then these are both issued by the state and they have their own requirements. So while your legal presence is determined by federal law, the requirements for those state-issued IDs can be more strict. And yes, many times the employees don't know the rules. To be fair, an individual employee probably doesn't see this circumstance very often (if ever) in many areas. In my area specifically, there's less than 1% immigrant population...I would be surprised if they knew the proper rules for my fiancee's circumstances.

i94 can be expired in some states but needs to be unexpired in others.

hello friends, finally I got my state Id from where I live Wisconsin,, while my AOS is pending..  went with my husband... dealing with the officer was not easy he was just saying she cant have blah blah ... the good thing we have printed out from their website that its allowed to have state ID with NOA and I-94 record.. we showed him that... he didnt want to admit that he didnt know the rules..lol he said she cant have using this,  this is for extension....my husband said what extension??? he couldnt answer that haha he just said i dont think you are allowed but you can try..... and we got a number,  took a picture and waited for my turn to be called.. to make a long story short,,, i have already my ID now... and I have a plan to travel to visit my sister in another state.. Maryland.. and my question is... my Id on the right upper corner it says not for federal purposes... what does it mean.. i cant travel using that??? please help.. thanks

Congrats on your state ID, I believe you can travel with your state issued ID provided it met the REAL ID ACT passed by Congress. I believe your ID meant you can't consider it as a Federally issued ID and can't be use as such. I will suggest you call the Airline and find out if they will accept your state ID. 

I am assuming you are travelling by airline, since you can't drive with a state ID.
