K2 Can't return to States with Dad

My friend is currently in VN with his daughter.

They are scheduled to return to US this week, but when they went to the airport they advised him that only he is eligible for travel and his daughter isn't.

They filed for ROC and they got a letter of extension, but it only lists his name and not his daughter's name.

He's now being told to contact the US embassy to inquire why his daughter did not receive the extension for her green card when they applied for ROC together.

They both were requested to get biometrics done when the I-175 was processed and now he does not know what to do.

 

His wife and he are separated and Im helping because he doesn't know English very well.

 

Is the daughter stuck in VN? Anyone have any experience on this?

He should have received two NOA1's, one for him and one for his daughter, if her name was included on the I-751 petition. Each NOA1 will list only the beneficiary's name. So his NOA1 will only have his name on it, not both (and hers will only have her name).

Your friend should contact the U.S embassy and apply for a transportation letter for her. The embassy will verify status with USCIS and issue one which will allow her to board the airline in place of her green card without liability to the U.S. port of entry.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!
