Hi everyone

 

My mom filed I-130 the application approved with WAC number, while they were LPR in October 2013 and now they are citizens, should my mom update this information and can it effect my application so far? Any advise will be greatly appreciated...

Yes they should contact the USCIS and update the information from LPR to US Citizen. Rest of the procedure will be same. But now as your mom is US citizen that make you a immediate relative to USC before it was Immediate relative of LPR. After she change it, you priority date will become current right away. Normally, in LPR case the priority date become current after a certain period of time which is not a case if she is US Citizen.

So if she updates it at uscis then after waiting these 3-4 years I can get a priority date and then do I-485 process can I do it inside the USA or must I do it from South Africa? Embassy and I am 38 years it will be alright?

Yeah, once she update her status. Plus what visa are you on in US right now?

No, you are mistaken. Immediate relatives of US citizens are children under 21. In your case, you'll be moved to F1 category, which is a bit ahead of F2B, currently processing 22 Dec 2010. You have to wait till your PD will get current.

Don't overstay your B1/B2 visa, you have to return home and wait till your priority will get current, otherwise you'll be banned, what will cause problems in the future issuing you visa.
