I submitted my spouse's paperwork on Monday. I recently got a letter from USCIS requiring more evidence. I submitted it with a joint sponsorship (father is co-sponsoring).

 

1. They are requiring to fill out the I-864 petitioner's Household size correctly of page 4. I only live with my spouse. I assume the correct number should be 3? The part that confuses me is, again, this is for my spouse. We are married. On Part 5 Item 3, it says if you're married, mark 1. So if I add the total up, it'd be a household of 3 but that means I'm counting my husband twice.

 

2. Same as above but for my father's household size is 4 (5 if you include me but I don't live with my parents anymore).

 

3. They're asking for the most recent tax documents for my join sponsor (father) because
4. He doesn't make enough to be above the poverty guidelines.. The thing is I did infact submit my father's 2016 taxes AND his W-2. He makes well above the 125% poverty guidelines. The only problem I can see is that my father files his taxes joint with my mother. Would my mother have to be a 2nd joint sponsor as well?

I think you are counting the household number wrong. The houseful number will affect what the 125% poverty line is since it varies with household number. That might be why they think he doesn't make enough. 

 

Is your mother you father's dependent? Does your father have other dependents? If his household is 4 then I understand he has 3 dependents? Were they claimed in taxes?

 

Household size, for the purposes of this form, has nothing to do with living under the same roof. You are the petitioner and you have to be listed. 

 

Father (joint sponsor)

Petitioner 

Wife of Petitioner (Beneficiary)

 

Mother (wife of joint sponsor)

Father's dependent 1

Father's dependent 2

 

So household size is 6

From my experience with having a joint sponsor you have to make all of the documents explicitly clear otherwise they send you an RFE. I got 3 RFEs for documents that I already sent. 

 

When you send off these documents i would recommend having a cover letter to make it more user friendly. 

 

Your household size will be 2 since it's just you and your spouse. 

 

Your fathers household would be 4 if you do not live there. Edit; see above the person above is correct 

 

Do the calculations and make sure your father earns enough to sponsor you with the household size he has. I believe the total he needs to show on his tax return is $30,500.  You can also include assets. 

 

It cant hurt to have an additional sponsor so adding your mother should help.

I'm trying to avoid adding my mom. Her situation is a little more complicated...

My father makes 58k/yr he's well above the guideline.

I did make a cover letter breaking down every piece of document (as well as in the correct order) on it.

 

So I understand that the household size between me and my husband is 2. Should I disregard what the form page 4 says to add it together, because that'll sum up as 3?

 

So it seems like to me that the reason they sent this notice is not because of failed proof, but because I inputted the household size incorrect?

I think that would depend on how your dad filed taxes. If she is a dependent, I am not sure you can take her out. If they filed separate taxes, maybe you can.

I think this might be because if you husband has income, he can claim himself as a household of 1, and you would be added to the dad's household. Would this make more sense with the sum?
