I-130 "Normal Processing Time" According to the USCIS

Hello,

I submitted my I-130 in December 2016.  I received my notice of receipt in December 2016.  I remember reading online the normal processing time is 6 months for I-130.  I received a RFE in April and I sent my response 68 days ago.  7 days after the USCIS received it, my case updated to "Response to RFE was received."  I read online it takes 45 - 60 days for the USCIS to respond to the response (if that makes sense).

 

I called today because it's been over 60 days since they received my response and my case was received over 6 months ago.  The USCIS agent put me on hold, then came back and told me "The normal processing time for I-130 is now 9 months."  I then asked her what about the 60 days for the USCIS to respond to a RFE response?  She put me on hold, then came back and told me "The 60 days is to update your case and we updated your case by notifying you that it was received."  WOW

Yeah, what sucks is them telling me the normal processing time is 9 months as soon as I hit 6 months.  The operator also told me "The TSC is now processing applications from September 2016."  I didn't want to argue with her, but its dumb to tell me information that was updated on April 30th when we are almost done with June.  That information she gave me was updated over 2 months ago.  Calling them is a waste of time

They are pretty bad at updating their website. Texas used to be way faster until a lot of petitions were transferred from Nebraska to TSC and Potomac back in Feb and March. 

 

Them saying that they're working on sept petitions is also a way of reducing the amount of inquiries that they might get. I'm sure they are working on october and november cases too. 

 

All you can do right now is wait for your NOA-2, I'm sure it won't be too long from now!

So i submitted my case late December and in April the TSC reviewed my case and sent me a RFE.  So, no way they are working on sept, oct or nov cases now because 2 months ago they reviewed my case which was submitted dec 30th

Even if they are working on december cases now they might still be working on sept and october too. Some cases get stuck in background checks for months, which might be the case for these sept petitions they told you about.

I understand and i am sure they have cases from 2015 that are still open.  If you go to the uscis processing time sure under their Tools section, you will see the tsc is working on cases from sept 2nd, but that sure was updated last on April 30 and today's date is June 28th.  So 2 months ago they told us they are working on cases from Sept 2nd.  But i am sure in the last 2 months they completed some cases

I am in the same boat, we submitted our I-130 petition on November 21st, 2016, our NOA1 is dated December 2nd, 2016, we are in Nebraska. We did not receive an RFE or any communication, when we log onto USCIS, it just shows "case was received". We are also patiently waiting, I cannot call USCIS right now because I am currently in Ukraine, visiting my wife but I suspect we would probably get the same answer as the OP.

 

All we can do is be patient and wait!

Yeah, i am not making any more attempts to contact the uscis until late September when my case reaches 9 months.  I was hoping to have my wife here with me in December (a year from when i applied or 13 months), but it doesn't look like it.  I am just afraid they wait until September, then they transfer my file to the local uscis office for an interview which would take 2 extra months, then nvc takes about 3 to 3.5 months and the embassy is another 2to3 months.  If that's the case then i am looking at around May 2018

Do you have anyone checking your mailbox for you? We opted for text and email notifications as well and our status just didn't change online. All we got was the NOA-2 in the mail.

I hope it doesn't take that long. Please be positive. I totally understand your pain. At least you've got a response. PSC is going backward and reviewing cases from Nov. 2015! Imagine how would I feel!

Thank you for the positive comment.  I am trying to stay positive, but the best thing for me is to try to forget about it because it bothers me when i start to think about it.  Even the congresswoman clerk who told me to contact her after she submitted the case expedite wouldn't even reply to my email.  Just to let you know, i hate bothering others or asking anyone for anything.  I sent her a follow up email which is my first email since meeting her in person in March, i sent her an email 3 weeks ago...( 22 days ago asking her if she followed up like she promised).  Then yesterday i sent her my second email asking her for the same thing.  So i waited 21 days to send her my second email.  Both emails are short and brief, but i am not sure why she hasn't replied.  I plan to wait a month from today to reach out to her.  That way i am sending her an email once a month almost.  Or i might go to her office and see what's stopping her from at least replying to my email.

I know she's helpless and not a nice person, but i voted for the congresswoman she works for and it's not a favor she's doing for me trying to assist me, that's her responsibility to assist her voters
