I may have told/asked this before however it has been awhile: I filed a K-1 (fiance visa) petition in 2014 for my Filipina "fiance"; It was approved rather quickly and went thru all the necessary channels then forwarded to the US Embassy in Manila. My "fiance" passed her interview and just before she was to travel here in January 2015 I learned from a mutual friend in Las Pinas that my "fiance" had alternate plans when she arrived here which included leaving me to go stay with her aunt in New Jersey and meet all the other men here that she had secretly been communicating with. I confirmed this to be true and she of course never came here.
I got curious lately about some things and called USCIC to confirm that I have no pending cases as far as USCIS is concerned however they are not able to tell me whether or not my case is still pending at the US Embassy there in Manila- How do I know if the case is still active or not there (other than the unpleasant task of calling them on the phone)? Is there a time limit that it automatically expires? It has been well over 2 years now... Any feedback is appreciated! 1f642.png

If she got the K-1 visa, it expires approx. 6 months after they give it her. So she can only enter the US during a 6-month period.

If she didn't get the K-1 stamped, the case is dead.

If she used the K-1 to enter the country, she is in the US illegally because she never married you.

Nobody will care at this point. You should have pulled the K1 when it happened. You can e-mail the consulate in Manila with her information if you are worried.

Thanks CoCo- I do know she never entered the US so I am OK there- By "stamped", you mean if she had entered the US within that 6 month period in 2015 after was granted?

I filed a K-1 for my first fiance in 2009 and that was all legit; She arrived here and we married but things did not work out and we divorced- Everything was done legally. But becuz I filed again in 2014 will there be a problem if I want to file again (multiple filer)?

I don't know. There are people on this forum who have filed multiple times without any problem. Others, have had problems. You might need hard evidence of your relationship.

Technically, there is no limit to how many times you can sponsor someone.

There is no restriction to how many time you file for K1. But in some cases you have to file for a multiple filer waiver. Plus as this will be your third time filing K1. You gonna have to put more proofs to show your relation is bonafide.

Thanks- Maybe is easier to marry there and file the spousal visa? I know that takes longer but is it a better idea than a 3rd K-1 filing?

I agree with you on it. As it will be the 3rd K1 which put you in the suspicious position that it might be just for immigration. So getting married and spending time with you future wife in her home country will be better.
