Thanks all for our help. We get my parents to help us to cosponsor. and we getting married ASAP. I was looking the forms and the first thing is his A-Number ... where i get that? or that space go in blank and USCIS fill that part?

Hello. We are back. So we get married on Nov/17 and we are ready to start putting together all the papers and send it. Ii have a couple questions.

 

Again, Husband came to the country with B1/B2, was admitted until 5/22/16 but He stays in USA. His B1/B2 visa still valid until Sep 20/ 2020.

 

I need to file the I-485 And the I-765 

Do I need to file I-30?

Send Checks separate? or only one check for both fees?

His visa is invalid, as soon as he overstayed it was voided.

Yes, I-130, I-485, I-765 - file all those 3 forms, and filing I-131 (Advance Parole) would be a good idea. It's free with I-485, and your husband may need it while he waits for his I-485 approval, even if he is not planning to travel outside of the US as of now.

 

As for the payments, two checks is better. USCIS announced couple of days ago that they started to accept credit cards to pay for many applications. I did not check it as I don't need it (July 2017 filer), but perhaps a credit card payment is a better option for you if it can be done in your case.

Thanks for your help. If I don't have the money right now to do I-485 and I-30 which one I do first? I will have the money for the other one in one or two months, but I just want to start the process. My Husband is sitting at home without doing anything and He is going crazy, and I'm going crazy

Since he is already in the US, those two forms can be filed together (concurrently). Filing I-130 first will not make the process faster. I am not sure, but it may even slow things down. In any case, it doesn't have any advantages as compared to filing concurrently. To end this very difficult period when he is not able to do anything (meaning working), he needs EAD, which he will get once his I-765 is approved. And I-765 is completely dependent on I-485. So even if you file I-130, you will not be any closer to getting his EAD until you file I-485.

 

As I mentioned earlier, perhaps you can look into paying by credit card. That way you can charge payments for both forms at the same time, start the AOS process, and pay part of the debt later. You would end up paying a bit more because of the interest accrual, but you would be able to start the process sooner.
