is this for new applicants? if someone has already applied, would this apply to them?

Visa Class: IR-1.

Country: Jordan.

Embassy: U.S embassy in Amman, Jordan.

Married: May 28, 2015.

Interview Date: Aug 17, 2017.

Interview Result: Approved.

VISA Received: Aug 21, 2017.

U.S Entry & Passport Stamp: Aug 25, 2017.

Permanent (Green) Card was produced: Oct 9, 2017.

Permanent (Green) Card was mailed to me: Oct 11, 2017.

Received My Social Security Card: Oct 29, 2017.

First Job in America: Dec 21, 2017.

I would probably feel the same if my K-1 journey was over.  Mine is only 3 months in and I am probably not even a quarter through it.  This can end up being a 2 to 3 year process of family based is allowed at all.  I believe the proposal only allows family based approval is the HB category is also fulfilled.  If my future wife has money and a needed skill, we may be able to get a K-1.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

There was a switchover in April to prioritize work visas over family visas.  Timelines are approaching record highs starting after that switch.  It is impacting the K-1s for sure.  I hope all is well with CR-1s.  It is all speculation now except for the increased timelines for us waiting on K-1s.

The point system would be for skilled workers, not family based visas. Like Canada, if you score 67 points or higher out of the 100, you may qualify to migrate to Canada as a federal skilled worker.

Does this mean IR-1/CR-1 and K-1 applicants have to have skills or money to apply or get approved?

That is what the proposal is right now.  The proposal severely restricts family based visas and GCs.  It isn't implemented as it was just announced.  No one knows for sure if this can pass through Congress and the courts but they have already switched priorities for processing.

Wait, isn't family based immigration the largest category? With more or less 65% load.

He's doing nothing to family based visas for immediate relatives, y'all.

 

Bill content:

  • Limit the number of refugees admitted annually to 50,000 (compared to the 110,000 refugees then-President Barack Obama announced he would allow in last year).
  • Kill the State Department’s Diversity Immigrant Visa Program, a popular lottery program that selects roughly 50,000 people annually to permanently live in the U.S., or roughly 0.3 percent of applicants to the program.
  • No longer offer green card preference to the extended family or adult children of immigrants already living legally in the U.S. Spouses, children under 18 and sick parents would still be given preference.

My understanding from the K-1 forum is that the K-1/CR-1 spousal visas are less than .4% of all visa filings.  The new proposal hits all family based visas & GCs.

What does "caretaking purposes" mean? So you would not be be able to sponsor a parent for a green card?

I am not 100% but spouse and minor child immigration doesn't seem to be affected. It affects the rest, siblings, parents, and adult children. For parents they are proposing a temporary residency visa, it doesn't look like any different than a tourist visa except no requirement to leave country every 3/6 months.

no it doesn't hit all family based visas. the bill is clear it literally says "maintains immigration preferences for the spouses and minor children of U.S. residents". spousal visas and minor children visas aren't included in this bill.

The bill hasn't been approved by Congress yet. but if it were to be approved by Congress then I think parents who aren't sick or don't need to be taken care of can't apply for a green card. That is the rub.  My fiancé's children are not mine but they are included in the petition.  Does this mean we are good if the US Citizen is the father but not if the minors are not the US citizen's?
