Hello, 

 

I am going to make appointment with Infopass, and unfortunately my jurisdiction is Chicago, which has chronic full schedule for next two weeks either due to short staffing or unkind atmosphere. 

So I am willing to travel a bit down to Indianapolis, or Milwaukee, but can I make appointment with these offices? 

Anyone knows?

I have AOS interview in July but I did not get combo while my OPT EAD is gonna be expired soon. So I'm going to ask if there is anyway to extend EAD or expedite AOS combo.

 

I gather all documents to request expedite combo but the chance is half half especially if have AOSS interview in 4 week...

I dont have experience qbout OPT but when you filed for AOS, I dont think you need to keep maintaining your current visa. You can try to walk in at your local uscis, or at other locations. Just prepare that they may refuse to do it or explain why.

Yes, I am aware that before my legal stay in U.S. is expired, and I applied to AOS, it extends the legal status until pending AOS decision is made by USCIS. So it seems that I will have to take a risk. Thank you for your input!

Just to be clear, did you apply for a new EAD based on your AOS application? If your I-765 is still pending, then request an expedite. If your EAD is based on OPT and it is set to expire soon but you did not file the I-765 with your AOS application, send in a renewal application ASAP and request an expedite. 

 

You can attend other offices. Some offices are more strict than others but you should be fine scheduling an appointment elsewhere. Check to see if there are reviews on the specific office. I attended an infopass in DC/VA but my office is in Maryland.

Long story but short

So what happened was that I have applied 485,130,131,765, and about 90 days of the filing date, I got RFE about financial support, or 864, notably. Because I was told by my attorney that they are gonna issue 765 anyway, we waited until deadline of RFE (about 150 days of the filling date), but no 765 (=EAD) is issued, which was quite uncommon, according to the attorney. 

 

When I requested E-inquiry about the excessive delay of I-765, it says that due to RFE in 485, every associated application was on hold, including I-765

 

But I replied to RFE on time anyway, and then waited until my OPT EAD is ticking out, when I asked my congressman to see what is going on. Upon Congressional inquiry, they scheduled us for I-485 interview without Combo card. Unfortunately, the interview date is a week after my OPT EAD expires. 

 

So in this case, can I ask for request expedite based on severe financial loss to a person as my employment is gonna be terminated? 

How do you think?

Are you currently employed or have a pending job offer? If you risk losing your job and your salary actually contributes to your household expenses, then the chances of you being granted an expedite is very very high. The EAD is a very separate document from your GC. Just call USCIS and tell them you want to expedite your I-765. 

 

If there is a pending RFE then USCIS will not process the expedite. But you said you responded to the RFE. Your status update should say that the response to the RFE was received and this is a green light to call in and request an expedite. It seems like expedites have a turn around time of about one week after request.

According to my attorney, because I am scheduled for the interview in mid July, he believes that RFE issue is resolved most likely, albeit without 100% assurance as no body but USCIS would know. 

 

Yes, I am currently employed, but my HR reminds me of I-9 verification, giving me a final notice that without properly providing acceptable documents listed by USCIS, my employment is gonna be terminated (I do have an official statement). My manager, however, promotes me to better paying compensation as I have shown devotion in June, and job offer is pending, which might take a couple of days. 

 

As a reminder, manager, generally speaking is not aware of immigration issues but HR is. 

So I am kind of waiting for offer letter that may actually gonna be documented such that when I request expedite, I can use it as an evidence. 

 

The reason I wanted to visit Infopass is if they can temporarily give me I-551 stamp just to extend employment eligibility until the interview as it is USCIS list of acceptable documents. You think it better to give a call to USCIS and request expedite?

You don't need your attorney to tell you if the response to the RFE was received. It does not need to be resolved, only received. You can check your status update online and it will tell you whether it has been received. If it's been received, don't waste time waiting for an infopass appointment. You can still go ahead and book one but it's a quicker turnaround to call USCIS and put in the expedite request. Make sure you give them your email address. Within 24 hours you will get an email from USCIS requesting that you fax proof of your need for an expedite. You don't need the offer for promotion as proof. Just send them current paystubs and explain in a letter where the money goes and why you need to keep working.
