Hello,

 

I am sponsoring my fiancée for the 129F K1 Visa, and I received NOA2 dated on 6/9/2017 that gave us approval and notified us that our app was sent to the NVC. We are patiently waiting to hear from NVC, and in the meantime I am preparing everything necessary for the interview.

 

I am currently unemployed and looking for work. I received a potential offer for a "temp to hire" position with a pharmaceutical company through a recruiting agency. This temp to hire job has a definite contract period with a high potential to be hired as a permanent employee after the contract period. The position pays well above the poverty line if the hourly rate is annualized. I am considering accepting this position, but I have one main question.

 

My main question is this: Is a "temp to hire" job that pays well (above the poverty line) sufficient for my I-134 Affidavit of Support to be deemed acceptable to sponsor my fiancée? I know that anyone reading this can only speculate, but I'd appreciate your thoughts.

How long is the contract for?

 

If like 3-4 months then I would possibly look a co-sponsor honestly. If contract was for say 2 years, then should be fine; but again this is just speculative. The only true safe answer would be have a co-sponsor available. Better to have it and not need it than need it and not have it.

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

The job for 3 months, and then it turns into a permanent role.

 

Don't they place more importance on your tax returns showing that you made a sufficient level of income last year? My income last year is well about the 20K minimum. Why do you say that having a co-sponsor is the safe answer? What is your experience? Did you get denied a visa for not having a co-sponsor with a contact to hire role?

My fiance and I we are on the same boat like you, except in your case, you have a job offer and possibility to turn it to a permanant job. what Ben&Zian tried to say is that embassies are different when dealing with affidavit of support, they might accept what you have may be they put you on AP and ask for a co-sponsor.

so if you could find a co-sponsor just add it to your application for visa if not just do what you believe in.honestly my fiancee she is on unemployment , no job offer and nothing is showing and no co-sponsor is willing to help us.and we still did not receive any letter from NVC about our case number although we got approved in june 14. I do wish the best luck to you and us.

I think it would definitely qualify (assuming you take the job), as it would be easy to get the employer to state your salary / earnings and for what period it would be for. Nothing on the I-134 statement indicates there's a time frame for meeting the minimum.

 

Maybe because I've been "seasonally employed" in the past that I feel this way. If you make above the poverty line in the year, regardless of whether that was in a single month or over the course of the entire year, it's still an "annual income" as far as your taxes will be concerned.

 

If you get employed there and can show you are receiving income from them (statement from the officer of your bank showing your account status, as well as a statement of employment showing expected earnings and date of employment), then you should be perfectly fine.

 

Bottom line is that if you meet the income requirements and know you'll be able to prove it, you shouldn't need to worry about a co-sponsor.

Especially the case if last years tax returns show you're above the limit... you're already golden.

how can someone how is unemployed and claiming unemployment benefits prove his/her income for the I-134F, is there a document proof for that? because someone who claim unemployment benefits he/she is paid so how to show that with your affidavit the amount of money the Dep of labor is paying you as unemployment benefits?
