Who's talking about fear or instilling fear here? Don't put words on me which I never said thank you very much. Nothing is perfectly fine or legal here no one has the same experience. Post here are personal not what you're mentioning. Are you a lawyer or did you write the immigration cfr/ sections? This has nothing to do with fear it has everything to with common sense.

By stating what you did above that they will be denied and deported for fraud if they get married before 62 days and file for AOS, you are inciting unjust fear based on an old myth that has nothing to do with USCIS.

NO, it's not a matter of personal experiences, or "common sense" (although, common sense would tell you a DOS item doesn't apply to USCIS to begin with)... It's a matter of what is fact and what is not. USCIS has no 60/90 rule that applies to ppl filing AOS from tourist visas PERIOD. The OP will need to have a bona fide marriage as everyone else filing for marriage based AOS. It's as simple as that.

 

I will say this once AGAIN - once and for all... IT IS PERFECTLY FINE AND LEGAL!

September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

December 8, 2010: Wedding date set; it will be on February 18, 2011!

September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
