Colombian brother questions

We are studying what it would take to bring my wife's brother here from Colombia. He is a recently retired doctor 63 years old with a tourist Visa. He came here once and liked it. I am reading here and it looks like minimum 13 years wait time. That's a long time. The wife thinks that because he has the tourist visa already that she needs to file an I485 along with the I130. Is this true? Does his being a doctor open any kinds of special categories?

Thanks in advance for any information. I know this is a little hopeless. I am just making sure there isn't something that I missed.

Yes, it is like a 12 year wait.

 

I don't think he can change status in the U.S. That is what your wife seems to be thinking about. He would be here illegally and could get deported. Maybe someone else can answer this.

 

Doctors have no special categories. Plus, he is not allowed to practice in the U.S. 

 

He might be able to access a green card by investing 500,000 dollars in the U.S. These are special projects because in order to access to the green card there are rules to follow (like the investment has to lead to a number of jobs, etc.). The issue is that basically you get the money back when the project is done, usually a real state project, with no return/profit because they know it is for green card purposes. Or he could visit every year. Colombia is pretty close, at least in comparison to other countries.

 

Maybe other people have other ideas.

nope, he doesn't qualify to adjust status in the US, as you stated, the petition for siblings belongs to the fourth preference, meaning that category has a very long time of wait, 13 years, siblings aren't immediate relatives for immigration purposes and belong to the last category. she can file for him, but currently the wait is 13 years

 

no special category, but if he want's to get a job here, he must pass the board certification process in the state he wants to work and then find an employer that would bring him here, if not, then he will have to wait 13 years, or just come to visit and enjoy his family here

I was hoping that there was something I missed. He is a great guy. I really like him. Of course, I know everybody feels that way about their family.

Apply for a research grant as a fellow or visiting professor ? Although he cannot practice as a physician in the U.S, he does have a lot of experience in his field. 

There is a good chance of needing a well experience spanish-speaking professor.

Does he want to go back to work? Not sure the practicalities of someone 63 seeking to obtain US certification etc,

I think there is no harm on applying for him, even if it takes 12-13 years. He can still visit with his visitor visa.
