What to do exactly when both are accepted. (k3 and cr1)

Ok. Both the CR1 and the K3 are filed. Once either or both are accepted, do you get to choose which one you want, how does that work. Which one gets them here the fastest is really the one we want. We don't mind waiting on a greencard, as long as she waits here.

So what steps are taken once they are both approved.

a. When K3 is approved it will be sent directly to NVC for final security check and assigning of new manila case number then few dasy will be sent right away to the US Embassy in Manila wherein beneficiary will be contacted for interview and medical appointment ( by mail).

b. When I -130 is approved it will be sent to NVC then from that time there will be more process to be done till the case is complete and will be sent to US embassy. However once in the States no further things to be dones like AOS etc...

p.s. we took the K3 route as we cannot wait to be each other but also took the hassle of gathering documents again for AOS /EAD and now about to remove condition of the status.

note: once K3 is approved and and case is already sent o US EMbassy, all you got to do is inform NVC that you will take K3 route that way they will hold the case and will sent it to the appropriate service center once it is needed for AOS adjustments.

The new reality is that you pretty much do not have a choice in the matter. Unless you CLEARLY indicated on the I-130 that you would prefer consular processing of the file, the most likely scenario is that the I-130, once approved, will be sent to the National Benefits Center and held there until Adjustment of Status is filed.How would you CLEARLY indicate your desire? Good question!! Although there is a space provided to indicate consular processing, it seems the concesus has been that still isn't clear enough. It's been suggested one may write a cover letter requestiing consular processing but again that hasnt proven to be a guarantee. Ive read on other sites where people have written in red on the application itself in various places what they want, but I wouldn't suggest recommend or even dare try that( my personal choice).

More recently the I-129F and I-130 are being adjudicated together at the same service center, approved together and the I-129F gets forwarded to the NVC , then on to the embassy/consulate for the K-3 interview.The I-130 goes to the NBC and waits.

The new regulations require that you notify USCIS of your intention to continue the CR1 by filing an I-824 with its $200 fee, after the petition is approved. Unless this is received, the I-130 is simply held until it is needed during the status adjustment process. It is currently unknown just how long a delay is injected by this extra step.

Ive seen 2 I-824 approvals that I can think of........one was 4 months and the other 8 months........and that's ON TOP of the processing for the I-130.

Khurram, That's a great idea. I want to do the same. Are you using a lawyer? Since we are both on the same timeline/consulate. I think we should stay in touch.

Now, I want to do the same and pursue the k-3 cause I miss my wife really bad. But do you think that it is a requirement to pay the fees and follow the procedure for both i-130 and i-129f route?? Like you, if I had a choice, I would just follow the quickest route.

It is not a requirement to pursue Consular processing of your I-130. The reason for the new extra step is that most people end up adjusting status. USCIS and DOS save a lot of extra processing of I-130 petitions under the new policy, hopefully speeding up other petitions.

No, that is not correct. Your I-130 getting approved any number of days before your I-129F was not addressed but in cases of timely filed I-129F's, the new reality is that both are approved the same day. We've seen some I-130's approved first, in some cases where the I-129F was filed three or more months after the I-130. In those cases, the I-130 does continue to NVC (NOT NBC).

Generally the approvals come either at the same time or I-129F first. In those cases, the I-130 is NOT forwarded to the NVC (National Visa Center). It is retained at the service center until either it is needed for AOS or an I-824 is processed to get it moving again.

Thank you. I know that this topic was about the two petitions being approved at the same time, but was just wondering if 2-3 weeks would make a difference or be considered 'approved at the same time' too.

The reason I'm wondering is because my VisaJourney timeline tells me it's possible that my I-130 gets approved 10 days prior to I-129F. I'll just wait and see what happens I guess.
