Agreed!  I am more than capable of doing it on my own as long as I am prepared with the correct steps to take and have all the proper documents, The fees are enough thru the process, why add lawyer fees to do it for me...

You really do not need a lawyer at all. Its just more money. Good luck. Just curious why Jamaica? It is far for a Kenyan, via the UK probably?

We chose jamaica because no visa needed, wanted to go to the islands for our wedding and we have friends there as well. Its just as far as coming to the USA

If you insist on marrying in Jamaica, then you have to go through the spousal visa route.

K1 visa is faster but your fiancé must be in the US within 6 months after getting the visa and you must be married within 3 months once in the US.

Some people don't care that K1 is faster.  The CR1 can and is a better option for a lot of people regardless of time apart.

Saying it's just OP and her fiance in the household, no matter what visa route they go; she has to earn 125% of the poverty guideline in the end ($20,300). If that part is secured, they will have to decide what options are the best for him/them. If they want to be together asap and both of them are okay with the fiance not being able to work and drive for at least 3-4 months, the K-1 fiancee route would be a good option. It's also more expensive since adjustment of status comes afterwards ($1225). CR-1 is the best option since it's cheaper and the fiance will be able to work, drive/get a drivers license and receive the green card upon entry in the US. It''s all up to what they think is the best for them.

No issues with getting married in a 3rd country. Yes you will have to file a separate I-130 for the child. The guides have all the info. The i-130 instructions form is also good to read. If also suggest you read about the entire process before you even file the I-130 so you know what will be required and not get stuck later on.

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

Thank You!!!!  for the G325A form, I know we both need one, but I'm guessing our daughter does not. Am I correct?

Again I suggest you read the instructions the G325a is no longer used for spousal visas. Go to the USCIS website. Though the forum is a great resource it should not replace the actual official website especially since things change from time to time.

The G325a is no longer available. You will need to fill out a I-130A but depending on the age, minors do not need a G325A/I-130A.

Thank you, I went to USCIS and saw that it has been phased out, also with filing the I-130 for each do I pay separate filing fees or 1 covers them both, I cant get a straight answer on that

True but that was not the reason for my post.

The question was whether the K1 is faster and that is what I answered.
