My fiance and I are planning on taking a trip to Jamaica and to marry while there, I am a US citizen and he is a citizen in Kenya!

When we return to our different countries, where do we start with filing?   He has a daughter and we want to file for her as well.

can anyone help?????

We are so lost!!!!

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

You guys went thru the fiancé visa option, right?

 

We will already be married once we file so I'm not sure the start to that process because we are marrying outside of both of our countries. Not sure if that matters.

Getting married in Jamaica will have any affect on the process in any way shape or form.  If you ultimately decide to pursue the fiancé visa process, you would not be able to marry in Jamaica.

Note: the K3 option is pretty much obsolete from what I hear (no longer processed really), so it would be between K1 (fiancé) and CR/IR1 (spouse). Just make sure you get the paperwork from Jamaica to prove you got married there.

just a heads up I know the I-130 will take a little longer to complete however it is less costly, and less forms to fill out with each approval.

 

The 129F once approved gets here, marry, send in more forms, wait longer. like I said it is also more expensive.

Poa,

No it doesnt matter where you marry, but remember check in Jamaica whether there are any residency requirements. Jamaica does not require a visa from Kenyans to visit for 90 or less days. 

 

The K1 is faster by maybe 6 months? But more expensive. We could not get married in Kenya as we are a same-sex couple and Kenya does not allow for gay marriages, so we had to go the K1 route.

 

Though once you are married, you cannot use the K1 option. It took us a total of 10 months from the date of application of the K1 to the time he got here. The CR1 I believe is a year?

My other question is,  How do I file for his daughter at the same time?

Do I need to file 2 separate  I-130's?

 

I've contacted a wedding planner at the resort in Jamaica and know all that's needed for them to do the marriage documents and what he has to do in Kenya for it to be recognized as a legal marriage in Kenya. So we are ok in that aspect. I just wasn't sure how it affects us filing here in us

If money is not an issue why not hire an immigration lawyer to do everything for you ?

Because an immigration lawyer is mostly advised when there is a legal problem like convictions and record, etc. It's a waste of money since they won't speed up the process or they aren't an assurance that everything goes smooth and quick, even they can mess up.
