Hello

 

I am a UK national. I applied for an extension of my B2 visa and they received it on 27 January 2017. My I 94 form was due to expire on Jan 28 2017.  I requested for an extension until  5/5/2017.  However I was told to stay in USA until a decision was made. I just received the approval notice on 6/21/2017 and the approved stay date is still 5/5/207. I would like to know if I have stayed unlawfully in the US from 5/5207?  should I leave the country immediately?

You left it too late to apply for an extension. Why did you wait unt the last minute? The recommendation is to apply around 45 days before the I-94 expiry date. 

You must now leave the country. But you were not planning on being here this long anyway so that shouldn't be a problem

for you. 

 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Thank you for your response. The reason is that I got a voluntary position at a research institute and it happened towards the end of my stay. I would like to know if my stay beyond 5/5/2017 is illegal? I have now received a job position at that same institute and I would like to know what the prospects are for my job visa H1-B, Is this going to affect the visa process?

Yes, you are now in an overstay situation and the longer you stay, the worse it will be. After staying in the US for an extra 5 months on an extension chances are you will not be allowed back in the US for some time anyway, but your overstay makes it looks like you don't care about the rules. You were given extra time and have now abused that privilege.

Probably would not impact a H1b, but being deported would so hop on that plane home.
