However the k1 visa shows immigrant intent. Its taking a risk to try to use VWP with a cancelled k1 in your passport.

This statement is confusing. How would he not know his lawyer cancelled the visa prior to your flight? Did your fiancé not know you were coming or that the flight was booked prior to him changing his mind?

 

Sounds like you made either a pre-mandated mistake booking the ticket not knowing the state of your relationship, or just booked the ticket thinking you could come to the US and try to fix whatever is going on between you two.

 

Either way, this sounds fishy and definitely messy.

This is a good point. I was asked at POE

1) when are you getting married (we'd arranged a date by this time)

2) do you understand what you have to do to fulfill the terms of the visa? Ie get married, and then apply for AOS.

 

I can't see how you could answer these honestly in the current situation and still gain entry on the k1 visa.

 

Using a tourist visa to enter for a marriage is visa fraud. Using a fiancee visa for any reason other than entering to get married would appear to be fraud too? That can affect not only your current trip, but your ability to travel to the US in the future.

Call the US Embassy that issued the visa.

I didn't enter on a K-1 but the person sitting next to me in secondary when I arrived was on a K-1. We were both asked to give the telephone number of the petitioner (in my case my husband and in his case his fiancée). My husband says no one called him but who knows - maybe they called the fiancée of the man sitting next to me? It's perfectly possible that they make a quick call just to check that your stories match, etc. For example if they ask you when the wedding date is and then call him to see what his answer is to the question... I would rather lose the cost of a ticket than be denied entry and sent back and found to be lying to CBP.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

This is not going to happen I bet you. and even they call it is okay because it is going to be a great effort on the relationship. Everything is possible to be fixed in one second.

A visa DOES NOT have to have a stamp on it to be cancelled. If her ex-fiance did indeed cancel the visa, she will not be let in. There is no other way around it. Please do not give advice to her that is going to jeopardize her wasting time and efforts traveling here only to be turned around.

A visa does not have to have a stamp on it to be cancelled. You have been given advise on how to find out if it is cancelled. Call the embassy and give them your information and they will tell you. If it is cancelled then you will not be able to use it to enter the US regardless if it has a cancelled stamp on it or not.

Do you hold a Philippine passport? If so, then the advise above mentioning ESTA and VWP does not apply to you. 

 

Was your K1 visa issued by the US Embassy in Manila? If so, then call them and ask them to check the status of your visa. That way, you will know for sure whether your visa has really been cancelled or not.

 

Scenario A. If your visa has been cancelled, then you will need a new and separate category visa to visit ie B1/B2 visa. I assume you don't have a B1/B2 yet at this time, since a B1/B2 cannot exist together with a K1. Once you get the K1, any existing B1/B2 will be cancelled. So you need to apply for a new B1/B2 visa.

 

Scenario B. If your K1 is still valid, it would be unwise to use it at this point. Because like others said, the CBP at POE will ask you about purpose of travel and if you say that you are going to see if you can fix the relationship (ie not get married) while entering the US on a K1, then you will be denied and turned away for sure. There was a poster here a few months ago who entered on a K1 and said at the POE that he was not sure when they are getting married and he was turned away and not allowed to enter. So if you want to enter the US to see your fiancee, then you need to get your K1 visa cancelled first and then once cancelled, you need to apply for a B1/B2.

How will I know if indeed my visa was cancelled. He said he was not aware that his lawyer already cancelled the visa when he informed her that we were not getting married. I got my visa April and just decided to go there July to see if we could still work it out and get married like as planned. Prior to booking the ticket around 2 weeks ago he I informed him he said its okay for me to go.then now he changed his mind again and informed me last min my visa was cancelled
