I met my wife last year 2016 and we married this January 9 in Texas and i filled in end of February and I got my EAD card in may 17th 2017 and I got my SSN this June and go my drivers license just June 21 2017 and I started working on to start my new cleaning company and I got my first contract which will start on Monday and I plan on working it with my wife starting next week cos its a 45 hours a week contract and I will get my First paycheck by end of july... But to my surprise I check my online status and found out that we have been scheduled for an interview middle of July.. We have bills like electric ,bank statement but my name is not on her lease cos she's living on government assisted apartment and they said she can't add my name on that lease but I planned on getting a lease when I get paid next month cos we can't get a lease without prove of income... My question is can we go to interview without a lease together, seems like this is faster that what I have seen... Advice please...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I filed in June last year and had my interview in October, so it's not unheard of, depends on how busy the office in question is.

The advice when you are missing pieces of evidence is to focus on what you do have. Try to gather as much relationship evidence as you can - joint purchases, bank account statements, bills/official docs sent to you at her address, mail addressed to both of you at the same address, photos, affidavits, power of attorney, living will, pictures of you together (during wedding and/or with family members), etc.

I could be wrong, but your wife being under government assistance (section 8?) could work against you. I only say this because the AOS stage is where the public charge issue can potentially be brought up. Hopefully I'm wrong or someone else who's in similar situation can give better advice. 

 

FWIW, I'm not trying to scare you intentionally but making sure you are all prepared for any potential interview snafu.

I think you are right as its unlikely his wife can get section 8 if she makes enough to support him at 125% of the poverty line. This however can be overcome by getting a joint sponsor.

Two separate issues here actually. Depending on where you live, the income threshold for section 8 is different. I'm looking at the public charge issue, because if his wife is getting section 8 now then what's the likelihood that the OP will need it as well.

It's probably a non issue, because they will be working soon and more than likely his wife may not qualify for section 8. I just wanted to bring it up as a potential issue during the AOS interview.

Housing is not an issue IF it's documented with the housing agency. If not documented, the wife has committed housing fraud. That's the only problem that may present itself.

so if you can't get on the lease since she is in government assistance housing where are you living? if your living with her then you are getting the public assistance benfit even if you are not on the lease as well as she did not declare another occupant. sadly the g325a will have documented where your living so no sense trying to hide it.

It's documented that's why they pay for the house for her and her name is on the lease... But both our names are on the light bill... What should I do ?

I was staying with her cos we had no money and I had no job or money to move her and I was hoping that our interview would be around 4 to 5 months after I receive my EAD card but it came so soon that I wouldn't have have a pay check to get a lease with our name... What would you do on my situation ?
