hi, with ur background as a former adjudicator i hope u can tell me an honest answer.my fiance refused to have a co sponsor. his on ssi earning 15,000$ annually which is below the 125% of the poverty guidelines for 2007.he has a part time job as an independent contractor that earns 7000$ annually.to some both of his annual income it is around 22,000$ which just pass the poverty guidelines. he doesnt have an income tax since 2005 .will this be a basis to deny me of a fiancee visa cos he doesnt have income tax return. he got a 1099 form for his part time, do u think they will honor this? pls help . ill have my interview by the 27th of april.

Just curious; Why does he refuse to have a co-sponser? He must realize with his income, he has no choice. Again...just curious.

It would be difficult to predict how the interviewer would view the financial documentation even if you provided all the details. A 1099 for 2006 and documentation of the SSI along with tax returns for prior years would probably be sufficient to prove the minimum is met. However, depending on the rest of the circumstances, there may be some extra scrutiny based on the low income. You just do the best you can and take your chances.

It would be better if your fiance would come here directly and ask for help but if you have the financial papers in your possession now, just what will you be able to hand over when asked for the I-134? Please indicate what you do have, not just what you don't have. There is plenty of help here but as has been indicated, a former USCIS adjudicator is not particularly qualified to tell you how a DOS officer will evaluate the totality of your case. USCIS doesn't evaluate financial aspects of I-129F petitions.

Facts are cheap...knowing how to use them is precious...

Probably forgot or didn't understand the difference. I recall once almost beating my head against the wall looking up a DS form on the USCIS website. Until I realized I was confusing things just a bit!

Wow! You started 2 threads with this same question and posted the same question in the thread started by Huskerkiev. Once isn't enough? :blink:

Huskerkiev probably isn't going to answer you. I knew when he started his thread about being a former ajudicator, he was going to get overwhelmed with too many people asking him questions and would not be able to keep up with the demand. It's obvious that he hasn't been posting anything for quite a while now and you will more than likely not receive a response from him for your question.

Hi Everyone.

I just wanted to chime in and let you know that I was still here albeit very busy in my personal life in preparation for my gal's arrival this summer and work.

Also, in discussing (with other members) the answering of these intricate questions, the consensus was that everything should be in the public forum and not via PM. This was for the benefit of the larger community of VJ members and that the resident expertise and experienece that makes up these various forums could be brought to bear on your specific question. I also recommend using the CFR's as they are the most current guidelines.

So, yes I have kinda backed off on answering most of the questions posed to me. Its nothing personal and I will chime in where and when I can in an attempt to be helpful, but if I don't think I can contribute, then I probably won't say anything. A lot of the procedural and borderline legal type questions I don't feel comfortable answering because 1) I worked there some time ago and things probably have changed in the interim and 2) I don't give legal advice because of the serious ramifications of being worng. The last thing I would want to do is advise someone of something only to have it slow down thier personal journey. So, I hope you all understand.

BTW the fellow who signed for your packet (Hienauer) is the director of the NSC - probably a generic rubber stamp type of thing. When he was the Omaha District office manager, I used to coach his kid in soccer

I don't think anyone here will blame you for that. With you actually being a former adjudicator, I would imagine you are being bombarded with questions.....probably more than you ever expected. ;)

I am sure it is near impossible to answer all of them.

Thanks for being here and taking whatever time you can, to answer those questions that you feel will be of benefit to everyone on this forum.

Nothing is more useful than actually getting those questions answered......right from the source. ( someone who actually worked for USCIS....and sharing all of that knowledge that you bring with you.)

April 20, 2007 Wife enters through JFK. The days of grabbing my dinners at the WalMart deli....are now officially over!!!
