Once USCIS approves your petitions the I-129f will be forwarded to NVC while they retain the I-130. If you decide you would like to continue w/the CR1 route then you will need to submit the I-824 for $200.

I have an I-130 pending, and I sent in I-129 a few days ago (waiting for NOA1). Even so, can we decide to go the the CR/IR route instead of the k3 route? We are thinking about this...

What would be the process then?

Thank you. (We live outside the US).

Is your I-130 pending in San Jose or the US (and if in the US, why???)

Unfortunately, I filed my I-130 ONE WEEK before the USCIS announced that we could resume filing I-130 at the local embassy/consulate (San Jose, Costa Rica). Otherwise I certainly would have filed in San Jose, Costa Rica.

My I-130 is pending in Vermont. (I would have sent it to USCIS in Central America that represents Costa Rica, but they only accept cash in Honduras and that was too complicated...long story).

I actually think the CR/IR might be easier (even if it's not as fast as a k3 visa), but now that I've sent in the I-129 I guess if I want to change back to CR/IR I have to pay another $200.

Is CR/IR or AOS (on average) quicker?

Thanks.

NYsenes: do you think it is more complicated to switch from I130/I129 back to CR/IR, or more complicated to do AOS?

It certainly is cheaper to do CR/IR.

Thanks.

I have heard the AOS process can be a real pain in the a** and can cause an extreme heartache in the relationships. I personally don't think the ppwrk is not all that bad but then again I'm a outsider looking in. Maybe someone who is actually going through it may be better to answer that question. We thought about doing the K3 b/c it was faster but after reading several posts and speaking to other couples going thru the AOS we decided the CR1 was the best bet for us. I didn't want to stress him w/all the adjustments of moving here and not being able to work or travel right away if he needed to. This way I figured it make a few months longer but once my hubby arrives we will be able to focus on our new life together instead of this process.

There was a thread tracking the timelines for ppl who applied for the I-824. Maybe you can do a search to see how long it usually takes.

I want to say the CR1 is probably quicker b/c once your spouse arrives within a month they will recv the SS card and green card. With the AOS it can take up to a year depending on which region you live in.
