British national, Pakistani national on spouse visa living in the UK.

I am a British national and am eligible to apply under the VWP. My husband is a Pakistani national with a valid spouse visa until September 2018, which will be extended when the time comes. We want to visit the US for his birthday for 7 days. I have completed the DS160 for both of us, paid the fees and scheduled an interview for next week. I work for the Home Office, equivalent of homeland security, my children, from my previous marriage, are all settled in the UK. My husband does not work at the moment but has savings in his bank account as so do I. What documentation will I need to submit other than wage slips, council tax, tenancy agreement, marriage certificate and bank statements for both of us to be accepted for a visa?

Your husband has to apply on his own for a tourist visa. Meaning, you will go together to the embassy but he will be interviewed separately and they will make a decision separately whether he gets the visa or not.

 

You can bring everything but the kitchen sink and they can still refuse the visa. It's up to the CO during the interview to decide. There is also no guarantee that they will look at everything during the interview. Often they make the decision based on the DS-160 and the interview alone. Seems to me like you've already gathered enough docs. Take them and hope for the best.

Thanks for your reply Millefleur.

 

That makes no sense.

 

Just because you have also applied for a tourist visa, doesnt mean you will be attending his interview with him; you won't.

 

Also as you are already VWP eligible they will most likely deny your B2 application. You will then need to state this denial when you apply for ESTA and any subsequent visa, for life. ESTA will then likely be denied and you won't be travelling anywhere any time soon.

 

The odds are definitely not in your favour.

Oh, I forgot that you were using the WVP. I don't know if they will let you attend the interview with him. Here, for tourist visa interviews, they do not allow family members inside. Only the applicant can go in. I don't know how it works in London, but they may refuse to let you in. That happened to me here when my husband applied for a tourist visa.

 

When you said you "completed the DS-160 for both of us" does that mean that you also applied for a B yourself? If so, heed what @az2014 said, if you are refused a visa you will lose all ESTA/WVP privileges.

I assume you mean UK Citizen? National is something else.

 

Why did you complete the DS160 for you or do you mean just him.

 

Your work is irrelevant he is the one applying.

 

You do not submit anything, you can use the VWP so just need a pre approved ESTA, he needs a B Visa, usually they do not need anything that is not asked for on the application.

JFH, yes my husband is a grown man,its called supporting your husband.

 

az2014,  read my question, I applied for a ds160, so I will be attending an interview also. Nowhere does it say that a VWP cannot apply for a B1/2. Actually I found the following statement: 

Travelers who are eligible for the VWP may apply for a visitor (B) visa, if they prefer to do so.

 

Boiler: you probably understood what I meant but still needed to correct me. For your information:

They are effectively the same thing. British National is the broad category, and a British Citizen is a specific type of British National. It is the only type with a "right to abode".

British National (Overseas), commonly known as BN(O), is one of the major classes of British nationality under British nationality law. Holders of this nationality are British nationals and Commonwealth citizens, but not British citizens.

 

So a British National may well need a B rather than the VWP.

 

Anyway of course you can apply for a B, what will you say when they ask you why when your plans fall within the VWP. Been there done that, my excuse is that it was a looong time ago before information was widely available.

 

Assuming your B is denied, then you need to update ESTA or if you have not applied tick the box that says you have been denied a visa, which may delay/ complicate an ESTA approval.

OP being a Brit National is he not allowed to travel VWP (I ask because I am clueless)

or does his birth country has something to do with him having to apply. At times VWP

gets denied & Embassies are at times different in operations, a few will allow family interviews

together & others give separate interviews unless one  party has challenges...best wishes

I think the OP is a Citizen of the United Kingdom of Great Britain and Northern Ireland. And sponsored her husband to immigrate. Quite common for extended Pakistan families to do this, find a husband for a daughter from the home country. Would also explain being unemployed.

 

The National thing threw a spanner in the works, often misused, not so sure in this case as she mentioned a Government job and might be expected to understand the difference.

British national (overseas) is a status bestowed Upon Hong Kongers after Thatcher negotiated a very very very bad deal for us. (And we will forever hate her for that).  Almost all of the holders are of Chinese acenstry. So our version of the UK passport doesn't have the soon-be- gone. "European Union" and is not eligible for ESTA. HK's British oversea territory citizen status ceased to exist after 97, Pakistanis who were also UK oversea territories citizens with connection to Hong Kong after 97 became citizens of Pakistan with Permanent residency in Hong Kong.  

 

If OP is a British national with connection to Hong Kong then she could register as a British Citizen after meeting certain residency requirements. Once she became a British Citizen, she's eligible for ESTA.
