after they arrive in the us i know that you have to be married within three months of their arrival day but when is the latest you can file for the change of status?

my wife and I have a few questions

After entry into the U.S. with a K-1 Visa, you have 90 days to get married. After marriage, you can submit your AOS (and EAD and AP if desired) application as soon as you receive your certified marriage certificate.

There is no real time limit on when you can apply, but the sooner the better, because after your marriage, you are technically out of status until you have a pending adjustment application.

A K1 goes out of status when their 90-day allowed stay has passed, as indicated by the date put on the I-94 when they entered. Marriage does not cut that 90 days short.

Meauxna, I think they were confused and referring to the removal of conditions... but I could be wrong. The status of the I-194 changes as soon as you file the AOS and the 90 day thing goes out the window. Ken & Maria

I hope that's what they meant. That could be very confusing to others starting out on this AOS trip.

two years means: from the day you get married ---- the day you file your AOS.

I came to TX on Sep. 4th 2005.

got married on Sep. 23rd 2005. (L)

we had our interview today, april 16th 2007.

we are approved. :D
