Ok I've been asking a lot about this as I am getting ready to send it in. I just don't want to get an RFE! I have read the I-129F package assembly guide on here many many times and I have everything on it now BUT I was browsing the RFE master list it says one person got RFE because they didn't include the beneficiary's birth certificate. That's not in the guide, I don't have that. Is that really required at this first stage?

While the beneficiary's birth certificate is not specifically required, it doesn't hurt to include a photocopy (scanned and printed is fine too) in your package. And honestly, there are plenty of things that aren't mentioned in the official I-129F instructions or VJ guide yet people include them to support their petition. It's better to have it than not because you never know when USCIS will issue a RFE considering someone actually got a RFE for not submitting the beneficiary's birth certificate.

 

If I were you, I'd rather postpone shipping out the package by a few days to a week so that I could obtain a copy of the document and include it than getting delayed much longer at USCIS stage waiting for the review to be continued upon RFE response.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

The beneficiary's birth certificate is not required by the USCIS during the first part of the K1 visa process. Only the petitioner's birth certificate and/or US passport with copies of ALL PAGES from the U.S. Passport. The purpose of this is to provide proof that the U.S. petitioner is in fact a U.S. Citizen by birth.  However, if you have it at your disposable and want to add it, that is totally your preference; but you will not get an RFE for that. The RFE master list while is a great reference, does not appear to have been updated in quite some time.

 

Beneficiary will be required to present his/her birth certificate at the interview which is the final steps of the process.

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken
