GI Bill...I864...anyone doen this before??

he did for sure for 2002, 2003 and 2004...we havent filled taxes for 2005 yet...

I see. I thought you meant here that he reported it as income from 2002-2004.

In light of the info that zyggy posted regarding the GI Bill, it looks like you have your answer. I'd start looking for a co-sponsor ASAP then.

If he gets a 1099, then he is not employed by anyone... In essence, he is self employed. The burden of proof for the I-864 for being self-employed is much higher that for someone who is employed. Not impossible, but more difficult.

Yeah.. he gets a 1099 for the payments for his services from his clients and he then has to pay self-employment taxes when he does his 1040. It's typical for any self-employed individual... where it get tougher, is that the USCIS adjudicator may request evidence that this type of income is relatively steady or that he has sufficient assets to weather the down tmes...

To be on the safe side, I would ask what was required for the I-864 for self-employed individuals on another thread and I would get a co-sponsor in my back pocket...

If he was employed by someone, then that employer would withhold his US and state income taxes and pay a portion of his Social Security and Meidcare taxes and at the end of the year would issue a W-2.

If this guy issues a 1099, then he is not your husband's employer. He is your husband's client for his self-employed business. There is a big difference...

You might also consider the option of him getting a part-time job. Forgot to add that earlier.

When your husband goes to file his taxes this year, you might raise these questions as well. IE: how much income is he considered to have (gross) and from what sources, etc.?

So, lets say he would get a new job today, and we would get a letter from his NEW employer stating that he works there and how much he makes and stuff we still wouldnt have any pay stubs since he would have JUST started the job, right?

Your case is just like mine. My husband is a Marine and his income not over poverty line. We had a co sponsor for our AOS (his daddy) and everything is good. Make sure that you issue I-864 for both your husband and co-sponsor. Eventhough your husband didn't make income over poverty line. The immigration officer still need that form from your husband.
