What happens if denied at the interview?

This is kind of downer of a question...but does anyone have experience with this? Our case is currently at the NVC stage and we are just waiting for them to review and accept our AOS and IV package. I'm just terrified of the possibility that we could do everything proper and my husband could be denied at the interview. Is there an appeal process if this happens? I have no reason to think we will be denied but I just want to be prepared. Any ideas?

I completely understand the feeling of enxeity, paranoia and all sorts of mixed emotions.

 

For those who are denied Visa, Embassy/Consulate sends your case back to USCIS and it takes a long time for them to actually send your case. After your case is received at USCIS, it will sit there for quite a long while and collect all kinds of dust. When they think that they can build the castle on your file from all the dust, they will contact you with NOID (Notice of Intention to Deny) which you can contest or you can file fresh after that.

 

All jokes aside, it usually takes 6 months minimum for USCIS to contact you back if your case is denied.

 

Don't worry, you will ace your interview. Just make sure to bring all the documents at the interview. Good luck.

Ugh. That's awful. though thanks for the honest (and comical) response. We will make sure to have all of the documents at the interview. It is so nerve-racking though...particularly because Ethiopia is considered a "high fraud" country so they often operate under the assumption that a couple is married purely for visa. We did live together for 5 months in Ethiopia after we got married (we have the rental agreement to prove it) and I spent an entire year there prior to our marriage (this is how we met). So, hopefully, in light of such evidence all will go smoothly.

India is a high fraud country as well. So, our situations might not be as diverse as you might think. When NVC approves your case, it most likely is a go from embassy. They just want to make sure, as you rightly pointed out, that the marriage is not a sham. When your relationship is genuine, they can tell by the way you respond. They make a living out of it. Don't stress, just go with confidence and make sure to go with every proof you have. Don't show them the proofs unless asked first. You will do great.
