Can someone please guide me in the right direction!

I am somewhat confused about which I864 to file. My situation is that my two children receive a substantial amount of social security disability benefits from my ex-husband. I have read that this type of income is not considered as assistance as is SSI. I receive the checks payable in my name, but I dont know if I can count that as part of my annual income since the money is received on the behalf on my children. I have looked over the forms and they state that I will need I864A completed by dependents over the age of 18 in order to use their income as consideration. Is this true? This would well put us over the guidelines and I am really hoping that we can use it.

Also I am confused to which form I would file. Would I qualify to use the I864EZ if I am able to claim the social security disability income?

My husband also owns 7% in two businesses here in Morocco. If worse comes to worse and I need to use that in order to meet the guidelines, how would we go about filing and what paperwork would we need to submit?

7/16/07: Case complete!

Interview: 9/6/07@8:00 a.m.

9/7/07 Visa in hand!!

the I-864A cannot be signed by persons under age 18.

since the benefits come in your name they are technically your income in the same manner in which child support would be considered your income.

to support the income you should send your 1099's and attach an explanation of the benefits origin.

Thanks for your input. The only problem with that is that I have never filed a 1099. I have been told that it wasn't necessary because the benefits are non-taxable. Could I just include the amount of benefits in the box with my annual income and attach a certified copy explaning benefits and amount I receive each month from the SSA office?

Unless what the children are receiving is actually SSI ( supplemental security income )the Social Security Administration should have sent you a form SSA-1099 in January, where it lists the benefits received for 2006 as well as a benefit letter saying what your benefits will be for 2007.

I believe you can request a replacement if you dont have what they sent you. I dont think there is an SSA-1099 for SSI.

Your best bet is to call SSA and ask exactly what the benefits are defined as and if they can give you a proof of income letter.
