Timeline

It can take months for your case to be sent back and the reasons given why your case was denied. Once you get your Notice Of Intent to Deny/Revoke you will have 30 days to respond. You must answer and provide proof for every reason the embassy refused the visa. Sometimes an extension can be asked for and given so you have more time to respond. I am so sorry you are going through this. We were also denied our visa and were reaffirmed by USCIS. If reaffirmed your case will be sent back to the embassy for another interview.

Hi---Could you tell me your story? When my husband was interviewed, they asked him about my divorces. They looked at him, rolled their eyes, and said, "So you are number 5?" He basically said they treated him like a criminal and told him if he was lying, he would never come here. He thinks they thought he was just after a green card. He just answered their questions calmly. The first guy asked him to show our wedding pics, which he did. We just got married by an Imam with 2 witnesses. They did not ask for additional evidence, which he had, which included proof of my 7th visit.

 

How long does it take to get a Notice of Intent? I am leaving for my 8th visit next week for 3 weeks. What if they just say they don't believe us? We already sent in 6 pounds/6" of evidence, I have visited 7 times (8th coming up), we had all kinds of evidence. I can't change my divorces nor our ages. I never really thought they would think we were frauds since we have been together for 6.5 years. We took our time getting to know each other before marrying. I can't imagine what they think, other than maybe they think I am "buying" a husband. Heck, if he wanted a green card, he would have gone and found somebody younger, etc., long ago. It's just crazy. He wants me to move there, but I need to work several more years, I need some meds, I have an elderly dog, my own home, my brother has MD, just a lot of things that I can't leave.

 

How did you get reaffirmed? Do you have to reapply? How long did it take to be reaffirmed? If you have a second interview, is it usually a positive outcome? I sure do appreciate your giving us some hope. I am 66, he's 50, so I feel like we don't have years and years to deal with this #######. Our health has deteriorated some these past few years (me--diabetes, blood pressure, old people stuff...lol; him--has developed high blood pressure and stomach issues). I just pray our health holds out as well as our money for me to keep running back and forth. Heck, it costs a fortune just to board my sweet dog.

 

We have our senators' people on it. They have been so good to call and follow up for us. I appreciate any info!!

your case seems very complex and a top immigration lawyer would be a good idea in my opinion

I have no idea where I would get a top immigration lawyer. And what could they do? We are pretty much broke from me having to travel back and forth. I have never seen where a lawyer could get anything done more than a regular person or a senator's office. I don't mean to dismiss you, but I can't see where they could help. Procedures are procedures.

The 6 pounds of evidence could have worked against you. That's a lot for them to sort through in order to prove your relationship is true. Also the embassy is under the impression that all Pakistani's have huge weddings so a small wedding could have worked against you as well.

 

My husband is my 4th and there is a huge age difference. They did a field investigation and talked to neighbors and friends. The people they talked to did not know he was married and a small wedding plus the marriage not being known through out the community were big red flags for them. They also said because I am a Christian and my husband Muslim the marriage was not legal. For what ever reason our Notice of Intent to Revoke arrived in one month. I hired an immigration attorney because they said we were not married. She guided me as to what evidence to gather and found that the marriage by an Imam was legal.

 

I also got reaffirmed 3 weeks after my lawyer sent in our evidence. I don't know why they worked so fast in our case. It can take 4 or more months to get the NOIR and months more to be reaffirmed.

 

Letters from his family and friends saying they know about the marriage are important. Continue to save chats and call longs, etc. Send in evidence for each reason they are denying you but don't go crazy with pounds and pounds of unnecessary paperwork.

Thanks so much Carolyn! I sure do appreciate your help. Did the letter of intent to revoke explain exactly the reasons for the denial? Jamil's family and friends know he is married. As far as we know, they did not check anybody. I think they had their mind made up when he walked in there. I think they think I an his sugar mamma, which is #######. The man works his butt off and makes his own money, although I have helped him some and sent the kids and him clothing gifts.

 

I just talked to my hubby again and asked him exactly what was said at his interview. He said during the first part of the interview, it was a black guy and a Pakistani guy. The black guy was very nice. He asked him where he lived, where I lived, talked about his business. where we met (Netlog, no longer in business). He asked what was he doing there. He told them he was drumming up business...he owns a tour business. Back then, business was pretty good before Arab spring. They asked him why only 4 or 5 people on his "friends"? He just talks to people, doesn't chase them. He has a core of people that he takes on tours and arranges for tours over and over, so he doesn't go for mass business. He told them I had visited one year ago. I don't go so much now because our school system changed their schedule and we went from 3 week breaks to 2 week breaks. He said everything seemed ok.

 

Then he went to a second room with a white Christian guy and the same Pakistani man. Things took a turn for the worse as far as the Pak's attitude. He never said a word during the first room visit. The white guy was reading our chats and taking notes during this second interrogation. So the Pak guy lit into my hubby. Asked him again about Netlog and why he only had 4 or 5 friends. Then he said she has 4 marriages, you are 5th. He said yes. The Pak guy rolled his eyes. That's when Jamil knew he was perceived as a green card fraud. So it apparently ended with them telling him he would hear from them soon. They kept his passport. When he left, he felt beaten down and treated like a dog. He knew that they thought our marriage was a sham just by the crappy way they treated him.

 

By the way, did you have a second interview? When was that? I don't see anything on your timelines. How did the second interview go? Did you go with him? What happened?

 

Anyway, thanks for the support. I am just so devastated. I thought for sure with all our evidence, our 6.5 years together, and 7 visits, we would not be perceived as frauds. We won't give up, and we won't let them break us.

It took 4 years for hubby to get his visa. A total of 3 interviews and 2 field investigations. You would know if a field investigation had been done. His neighbors and friends would have told him about a stranger asking questions about him. I never went to any of the interviews. I didn't have the money to travel like that. Don't torture yourself trying to figure out why the visa was denied. Wait for the Notice of Intent to Revoke/Deny it will explain everything. My husband's last interview after he was reaffirmed was the worse one. Like your husband he interviewed with 3 men. He stayed calm and cool. They yelled at him, called him a lie, told him to apply for a work visa which is a trick they use. If he had shown any interest in the work visa he would have failed the interview.

 

There are organizations that are low cost that help people trying to immigrate. Look up Catholic Charities in your area. Call them and see if they have immigration lawyers. Their fees are based on your income. They help any one it doesn't matter what religion you are. My lawyer was a 45 minute drive away but she did an excellent job and our case was reaffirmed. USCIS is not the embassy they are more objective when looking at evidence but don't over load them.

 

If possible be with him at the next interview. They might be just as hard on you as they have been on him be prepared for that and as I said continue to keep records of calls, emails and chats. Also take pics with his family members and write on the back of the pic the dates and who the person is.

Holy Cow, Carolyn---Why did they reject you the second time? What evidence had you provided between each interview? I don't see why they deny when you have been married that long, etc. How many trips had you made there between each interview? Did you submit evidence with the original CR1 each time, or did you have to start all over? 4 years...omg, I would be 70 years old.

 

Could I ask you and your hubby's ages? How long had you been together by the first interview? How many trips had you made each time? I have no children, he has 4, but 2 are already out of college, the other two are in high school. My hubby owns a tour business plus an export business, so he's not poor, although the economy stinks. Do you have kids? What does your hubby do for a living? When did he finally get his visa? Sorry for all the questions, but you give me hope.

 

How did you convince them your marriage was real? WTH is the marriage certificate and marriage registration, if not a real marriage?

 

Does your lawyer help people in other states?

feeling sorry for you. Our heart goes out for you guys.

 

We had issues too. We were never married but had age difference. 1st interview in Delhi was super cold one.. they even asked me questions like HOW MANY TIME YOU HAD SEX WITH YOU WIFE? And my wife was with me for the interview. They made he sit down in waiting area

 

The denied us right then. We were in tears .. our family and friends along with congressmen sent emails to embassy. Within 30 min of our denial embassy received more than 200 emails from our friends and family in US along with our congressmen office. 

 

My wife visited back for more info. Within 48 Hrs I guess they said the document was sent back. We were crushed but we never lost hope. It took us another 18 months or so but we had our second interview and now we are approved.  Thi second interview was awesome 'coz the interviewer was warm and allowed my wife to be with me. She asked me questions and my wife questions and we heard the golden words

 

They sent us a detailed information informing why we were denied. We worked all out with proof. Like my parent's death certificate and all other questions, they had about our validity of the marriage. 

 

My wife is a teacher and I am into Computers. We too worked very hard ( I used to work 40 hrs straight shift).. ate same meals every day.. wore same old clothes.. saved every single penny and lawyered up. having lawyer makes a positive impact (that is what we felt, even thou they know #######.. we were telling them stuff as I read a lot)
