Applying for SSN while AOS is peding

Hi guys! I'm having a bit of problem trying to apply for a SSN at my local office. I waited until married because I wanted my new name on the card. Applied on the same day I sent my AOS forms to USCIS. 8 weeks later receive a letter saying they couldn't verify my documents because my immigration status had changed. Now my I-94 is expired. Wondering If I have to wait until I receive my EAD card to apply again or If I can apply again now.

Yup, you need to wait for the EAD now. While some people have had success getting the card in the married name, many have had issues. It's just easier to get it sooner and in the maiden name first, then change it later if desired. There's no immediate need to have it in your married name and sometimes waiting to get that - as was the case here - results in having none for a period of time.

Too late on K-1, as per previous replies, you must wait on EAD now. For those who are nervous about getting an SSN with your maiden name on it, don't be, it can always be changed afterwards — your SSN number will stay the same, as it's yours for life, and you can always update the name for free.

You could try using your maiden name if your visa has not been expired long, and maybe get lucky.

 

I tried a couple times well after the visa was expired, and the people at the social security office were confused as to why they were getting errors.  I knew what was up though, and was simply told they would call me later.  They never did.  I just wanted her to have SSN so I could open a joint checking account.  I was able to find a smaller local bank who opened an account for us without SSN.

They need a valid proof of status and his i94 is expired so going there and trying will be pointless

that's why it's highly advised to get ssn asap and before marriage and with the name in passport/ visa

Would you advise to get married after the SSN arrives? The ideal timeline would be: POE, wait until I-94 is updated, request the SSN, and get married how long after?

Once you're in the SAVE system (after entry), you can request the SSN and shouldn't have to go through manual verification (unless something is off like a typo or sometimes a truncated name). The VJ guide suggests waiting 2 weeks to ensure this happens, albeit it sounds like most people are in within a couple days now.

 

But just to clarify, you can get the SSN in your unmarried name at any point (after in SAVE) up until 14 days before the I-94 expires. You can be married still. The issue some people encounter is trying to get the SSN in their married name.
